Common use of Emergency Switching Clause in Contracts

Emergency Switching. ‌ Subject to item 4.8 of this Schedule 8, if a party reasonably considers that switching must be carried out urgently to avoid a serious risk of damage to property or to avoid any risk of injury or death to any person (“Emergency Switching”), that party may, with as much notice as is reasonably practicable in the circumstances: (a) request the other party to carry out switching on that party’s assets, plant and equipment; and/or (b) carry out switching on its own assets that may affect the Transmission Network Connection Point. A party must use all reasonable endeavours to comply with any request made under this item 4.7.
