Energy Planning and Management Program. The Customer shall, or the Customer shall cause its Host Utility to develop or maintain and implement either an individual or joint Integrated Resource Plan, a Small Customer Plan or other acceptable plan in accordance with the provisions of the “Energy Planning and Management Program; Integrated Resource Planning Approval Criteria” published in the FEDERAL REGISTER on March 30, 2000 (65 Fed. Reg. 16789, et seq.), and any subsequent amendments thereto, as codified at 10 C.F.R. §§ 905.1-905.40. Any failure by the Customer to maintain such standards shall not be deemed a breach of this Contract; provided, however, that if Western determines that any plan or report prepared by the Customer that the Authority relies on to satisfy its obligations under the Criteria is deemed inadequate, the Customer agrees to take any corrective action necessary and pay any penalties imposed by Western for failing to take adequate corrective action.

Energy Planning and Management Program. (a) The Customer shall, or the Customer shall cause its host utility to develop and/or maintain and implement an Integrated Resource Plan, Small Customer Plan or other acceptable plan in accordance with the provisions of the “Energy Planning and Management Program; Integrated Resource Planning Approval Criteria” published in the FEDERAL REGISTER on March 30, 2000 (65 Fed. Reg. 16789, et seq.), and any subsequent amendments thereto. (b) The Customer shall, or the Customer shall cause its host utility to develop an Integrated Resource Plan, Small Customer Plan or other acceptable plan suitable for the Customer’s geographic area and type of utility, if any, and submit said Integrated Resource Plan, Small Customer Plan or other acceptable plan to the Authority for submission to Western. Approval and periodic review and verification by Western of the applicable Integrated Resource Plan, Small Customer Plan or other acceptable plan shall be in accordance with the Energy Planning and Management Program; Integrated Resources Planning Approval Criteria, and any amendments thereto. (c) If the Customer or the Customer’s host utility purchases firm capacity, with or without energy, from Western under a long-term firm power contract, or is a member of an association that does, and has an obligation under Section 905.10 of Title 10 of the Code of Federal Regulations independent of this Contract to prepare an Integrated Resource Plan, Small Customer Plan or other acceptable plan, the Customer shall, or the Customer shall cause its host utility to maintain that plan consistent with applicable regulations and any requirements imposed by Western, and the Customer is not otherwise required to submit a plan to the Authority pursuant to subsection (b) of this Section 35.

  • Procurement Planning Prior to the issuance of any invitations to bid for contracts, the proposed procurement plan for the Project shall be furnished to the Association for its review and approval, in accordance with the provisions of paragraph 1 of Appendix 1 to the Guidelines. Procurement of all goods and works shall be undertaken in accordance with such procurement plan as shall have been approved by the Association, and with the provisions of said paragraph 1.
