Erosion Control Plan. 1. Prior to the commencement of construction, the Developer must receive approval from the City of an erosion control plan that conforms to City, state and federal laws and regulations. The Developer shall comply with the approved erosion control plan at all times or be subject to daily citations and penalties.
2. It is the Developer’s responsibility to ensure permits are also received from any other state or federal agency as may be required, including under NR 216 of the Wisconsin Administrative Code.
3. In the event the Developer fails to comply with the erosion control plan and fails to take timely and corrective action with respect to correction orders, the City may take any action reasonably necessary to implement the approved erosion control plan and all costs to implement said plan shall be the responsibility of the Developer. In this event, the City may draw upon the Developer’s letter of credit under Section IV, Subsection C of this Agreement to cover the costs of implementing the erosion control plan.

Erosion Control Plan. Erosion Control Plan will be updated to reflect the new limits of construction. Erosion concerns presented by installation of the retaining walls and the widened ditches will also be addressed. The cofferdam locations and sediment basin locations will be reevaluated.
