Excused Absence Method. ▇▇▇ shall not be responsible for payment for more than 8 cumulative days of absences, for each of the first ninety days and second ninety days of the school year (i.e., semester), unless a written time extension is granted by ▇▇▇. No more than three of the 8 cumulative absences shall be unexcused. Reimbursements for Related Services cannot be claimed except in the case of a Bundled tuition rate. On the 4th consecutive day of a pupil’s absence, CONTRACTOR shall notify LEA of such absence. If CONTRACTOR fails to provide such notice by the 4th day of consecutive absence, CONTRACTOR shall not be compensated for services delivered during continuing absence after the 4th consecutive day of excused absence. All excused absences must be verified and a copy must be submitted to LEA with the monthly invoice. All documentation must be kept for at least five (5) years from the date of origination. Only the individuals listed below may verify the reason for absence: School or public health nurse Physician Principal Teacher School employee assigned to make such verification Student eighteen years of age or over Parent Any reasonable method which established the reason for the absence may be used: Written note from parent, guardian, representative or adult pupil (over 18 or emancipated) Telephone conversation with parent, guardian, representative, or adult pupil (over 18 or emancipated) Standards for excused absences are defined in the education code. Contractor is responsible for verification of excused absence in accordance with current requirements. Criteria for a billable day for payment purposes is one (1) day of attendance as defined in California Education Code, sections 46010, 46010.3 and 46307. ▇▇▇ shall not pay for services provided on days that a student’s attendance does not qualify for Average Daily Attendance (ADA) reimbursement under state law. Per Diem rates for students whose IEPs authorize less than a full instructional day may be adjusted on a pro rata basis in accordance with the actual proportion of the school day the student was served. ▇▇▇ shall not be responsible for payment of related services for days on which a student’s attendance does not qualify for Average Daily Attendance (“ADA”) reimbursement under state law, nor shall student be eligible for make-up services. NONPUBLIC AGENCY STAFF ABSENCE When CONTRACTOR is a nonpublic agency and CONTRACTOR’s service provider is absent, CONTRACTOR shall provide a qualified (as defined in Section 7 of this agreement and as determined by LEA) substitute, unless LEA provides appropriate coverage in lieu of CONTRACTOR’s service providers. ▇▇▇ shall not pay for services unless a qualified substitute is provided and/or CONTRACTOR provides documentation evidencing the provision of “make-up” services by a qualified service provider within thirty (30) calendar days from the date on which the services should have been provided. CONTRACTOR shall not “bank” or “carry over” make up service hours under any circumstances, unless otherwise agreed to in writing by CONTRACTOR and ▇▇▇. In the event services were not provided, reasons for why the services were not provided shall be included. NONPUBLIC AGENCY STUDENT ABSENCE If CONTRACTOR is a nonpublic agency, it shall notify LEA of the absence of a student no later than the fifth (5th) consecutive service day of the student’s absence, as specified in the LEA Procedures. ▇▇▇ shall not be responsible for the payment of services when a student is absent.
