Expansion of Service. Concord agrees to provide water service to new and expanded uses on the parcels within Concord’s 2A Service Area in Acton that do not front Acton Water District’s water distribution system up to a total commitment not to exceed of 61,000 gallons per day for the combined demand from existing, new, and expanded uses in Acton, as reflected in Exhibit B, so long as: i. All existing water withdrawal rights established by Concord from Nagog Pond are maintained, and, to the extent required, Concord receives commensurate authorization for any such increased demand in Concord’s 2A Service Area in subsequent Water Management Act permit renewals. ii. The proponent of such new or expanded use, in accordance with Concord’s Rules and Regulations Governing Water Use and Connections (as amended), (1) files an application for water service with the Concord Public Works Water/Sewer Division that includes a water demand impact analysis and Concord concludes that such proposed new or expanded use, including any approved demand mitigation requirements, will not compromise service to existing customers or exceed Concord’s ability to supply said capacity, and (2) following completion of construction, provides Concord Public Works Water/Sewer Division an affidavit demonstrating the approved demand mitigation requirements have been implemented prior to Concord activating the water service.
Expansion of Service. During the Term of this Agreement, the potential exists for the 9-1-1 Serving Area to be modified by the County. Such modifications shall constitute a proposed amendment to this Agreement, and shall be made in accordance with section 16. Payment for any additional populations included into the 9-1-1 Serving Area shall be prorated to the end of the current contract year in which the service is expanded, and included in the total population figure for the remaining years in the Term and any subsequent renewal periods thereof. The increased payment will be based on the expanded population and shall be made in accordance with section 5.1 of this Agreement.
Expansion of Service. SYGMA will provide distribution service for El Torito's expansion in the service area of another SYGMA distribution center, at El Torito's request, when El Torito has twenty (20) Restaurants open in such area and once mark-▇▇▇ have been agreed upon by El Torito and SYGMA. In the event no SYGMA distribution center is within the new service area, El Torito may select a SYSCO operating company within the service area. Notwithstanding the above, SYGMA will evaluate the feasibility of service to fewer than twenty (20) Restaurants at any time during the term of this Agreement.
Expansion of Service. 3.5.1 If the 9-1-1 Serving Area, as set out in Paragraph 5.2.2 of this Agreement is modified by the County to include those areas that are located geographically within the County of Middlesex but are not part of the Middlesex 9-1-1 PERS Serving Area, then this agreement will be amended in consultation with the Strathroy-Caradoc Police.
Expansion of Service. (a) The Town shall have the right, at its sole expense, to construct and connect transmission mains, main pipe extensions, hydrant branches and service connections located within ▇▇▇▇▇▇ to the Interconnection Point, in accordance with all applicable industry engineering standards and practices, to supplement its current service and provide additional service within the Town, but not to provide water service outside of the Town. (b) For any future expansion of Company services, operations or infrastructure that may affect the Town’s distribution system and or storage tanks, the Company shall provide the Town a summary of the planned expansion in writing for Town review and comment. If a Company water main expansion results in a necessary but unplanned upgrade to the Town’s distribution system, then the Company shall be responsible for those upgrades.

  • Extension of Services Upon written notice by Recipient to Provider at least sixty (60) days prior to the end of the applicable Service Period for any Service (unless the Schedules hereto specify that such Service is not eligible for extension), Recipient shall have the right to request that Provider extend the Service Period of any Service so that such Service ends on the earlier of (a) ninety (90) days following the last date on which Service Provider is obligated to provide such Service in accordance with the terms of this Agreement and (b) the Term (each such extension, a “Service Extension”). If Provider agrees to provide such Service during the requested Service Extension period, then (i) the Parties shall in good faith negotiate the terms of an amendment to the Schedules hereto, which amendment shall be consistent with the terms of the applicable Service; and (ii) the Charge for such Service during the Service Extension period shall be equal to one hundred twenty five percent (125%) of the Charge for such Service plus all costs, fees and expenses unless otherwise specified with respect to a particular Service on the Schedules hereto, or in the other Ancillary Agreements, payable by Provider or its Subsidiaries to a Third Party to the extent resulting from such Service Extension (to the extent not already included in such Charge); provided that, if such Service Extension is the result of Provider’s failure to provide the Service during the applicable Service Period (the amount of time that Service Provider so failed to provide such Service, the “Service Suspension Period”), then the Charge for such Service during the Service Extension period shall be equal to (x) one hundred percent (100%) of the Charge for such Service, for a number of days equal to the Service Suspension Period and (y) one hundred twenty five percent (125%) of the Charge for such Service plus all costs, fees and expenses unless otherwise specified with respect to a particular Service on the Schedules hereto, or in the other Ancillary Agreements, payable by Provider or its Subsidiaries to a Third Party to the extent resulting from such Service Extension (to the extent not already included in such Charge), for the remaining days of the Service Extension period, if any. Notwithstanding the foregoing, the Service Period of any particular Service (1) may not be extended more than once and (2) may not be extended later than the Term. Each amendment of the Schedules hereto, as agreed to in writing by the Parties, shall be deemed part of this Agreement as of the date of such agreement and any Services provided pursuant to such Service Extensions shall be deemed “Services” provided under this Agreement, in each case subject to the terms and conditions of this Agreement.

  • Suspension of Service (a) SORACOM may suspend provision of the SORACOM Private Network Service if: (i) there are unavoidable reasons requiring maintenance or construction of SORACOM’s Telecommunications Facility or system; (ii) a telecommunication carrier suspends provision of telecommunication services to SORACOM; (iii) a cloud service provider suspends provision of cloud services to SORACOM; or (iv) SORACOM changes the Subscriber ID under Section 3.4(b). (b) If SORACOM suspends the provision of the SORACOM Private Network Service according Section 5.4(a), SORACOM will announce such suspension on SORACOM’s website in advance except in cases of urgent necessity.

  • Suspension of Services We have the right to suspend the benefit of any Credit Union service at any time for reasonable cause. At Our discretion, We also have the right to pay any share draft presented for payment from Your Account after Your Account is closed or suspended and to recover such amount paid from You.

  • Completion of Services (a) The Customer must: (i) notify Deswik in writing as soon as the Customer becomes aware of any defects in the Services; or (ii) provide Deswik with an email confirming successful completion of any Services Deswik advises the Customer have been completed. (b) If the Customer does not notify Deswik of any defects under clause 5.4(a)(i) or provide Deswik with an email confirming successful completion of the Services within 14 days of Deswik notifying the Customer that the relevant Services are complete, the Customer is deemed to have accepted the Services. (c) If the Customer notifies Deswik of any defects under clause 5.4(a)(i), Deswik will, as soon as possible investigate and (where applicable) undertake rectification of the defects. Upon completion of any defect rectification the Customer must promptly provide an email notification of the successful completion of the services, unless further defects exist. In this case, the Customer is further required to notify Deswik of such defects.

  • Term of Service Except as otherwise provided in this Agreement, Atlas shall serve as the Managing General Partner of the Partnership until either it:
