Exploratory Drilling. (a) before commencing any mining program for Wollastonite on the Mining Claims, the Lessees shall carry out sufficient exploratory drilling to he able to formulate a mining plan for the Wollastonite to be found on the Mining Claims. The Lessees shall prepare a preliminary draft of this mining plan and shall submit it to the Lessor at least sixty (60) days prior to the date when the Lessees propose to commence mining for Wollastonite on the mining Claims. The Lessor shall have thirty (30) days after receipt of this preliminary draft to make comments and suggestions to the Lessees about the proposed plan. These comments and suggestions shall be given serious consideration by the Lessees in the formulation of the final draft of this mining plan, which also shall be submitted to the Lessor. (b) Respecting the exploratory drilling required under Subparagraph 6(a) above, the Lessees shall: (1) Take samples in such manner as to provide the Lessor with duplicates of each sample so taken, as properly divided, bagged, and labelled; (2) Provide the Lessor with true copies of all assays, geological data, reports, and all other information obtained respecting the Mining Claims; all of which shall be at the sole expense of the Lessees.
Exploratory Drilling. Beginning on January 1, 1990, Mesa shall --------------------- have the exclusive right at any time and from time to time, to conduct the drilling of Exploratory Wells, or to conduct the deep▇▇▇▇▇ (or Side Tracking) of existing wells not then producing in p▇▇▇▇▇ quantities, into geologic formations the depths of which are below mean sea level. Mesa shall nevertheless give CIG written notice at least two weeks in advance of the commencement of any such operation specifying the nature of the operation, the location, proposed depth and objective formation. 6.2.1 The cost and expense of any such operation which is drilled and completed, or abandoned, into a formation the depth of which is below mean sea level will not be treated as a Capital Expenditure (as otherwise provided in paragraph 6.1.2 for Reworks and Redrills). The costs, liabilities and expenses of any such operation shall be borne entirely by Mesa, and Mesa shall receive all gas produced from any such completion subject to the terms and provisions of the "B" Contract. 6.2.2 Any such operation which is plugged back and completed in a formation the depth of which is above mean sea level shall be regarded as a Rework or Redrill, and the cost and expense of the completion operation following the plugging back of the well shall be treated as a Capital Expenditure as provided in subparagraph 6.1.2 above. All other costs, liabilities and expenses involved in the drilling of the test, in the abandonment of the bottom of the well bore, and of plugging back shall be borne entirely by Mesa. Provided, however, that all mutually agreeable costs and expenses incurred from the surface down to that depth at which completion of the plugback was accomplished shall be deemed a Capital Expenditure to be accounted for pursuant to the provisions of the attached Exhibit "C".

  • Feasibility Study This Agreement shall be considered “As-Is with Right to Inspect”. Buyer shall have a period of 15 [if blank, seven (7) days] from the Execution Date to determine whether the Property is suitable, in Buyer’s sole and absolute discretion for ▇▇▇▇▇’s uses. During the Feasibility Study Period, Buyer may conduct a property inspection, title examination, environmental audit(s), surveys, review of zoning, land use and legal proceedings and any other tests, analyses, and investigations to determine the Property’s suitability to Buyer’s needs. ▇▇▇▇▇ will deliver written notice to Seller prior to the expiration of the Feasibility Study Period of ▇▇▇▇▇’s determination of whether or not the Property is acceptable. Buyer’s failure to comply with this notice requirement will constitute acceptance of the Property as suitable for Buyer’s intended uses in its “as is” condition. If the Property is unacceptable to Buyer and written notice of this fact is timely delivered to Seller, this Agreement will be deemed terminated as of the day after the Feasibility Study Period ends and ▇▇▇▇▇’s Deposit(s) will be returned after ▇▇▇▇▇▇ Agent receives proper authorization from all interested parties. Thereafter, the parties shall have no further mutual obligations under this Agreement. Seller makes no warranties whatsoever, including marketability of title, and in the event Buyer fails to provide written notification of its election to terminate this Agreement before the end of the Feasibility Study Period, Buyer accepts the Property “As-Is”. ▇▇▇▇▇’s failure to timely close thereafter shall be deemed a breach by the Buyer.

  • Development Work The Support Standards do not include development work either (i) on software not licensed from CentralSquare or (ii) development work for enhancements or features that are outside the documented functionality of the Solutions, except such work as may be specifically purchased and outlined in Exhibit 1. CentralSquare retains all Intellectual Property Rights in development work performed and Customer may request consulting and development work from CentralSquare as a separate billable service.

  • Career Development The City and the Union agree that employee career growth can be beneficial to both the City and the affected employee. As such, consistent with training needs identified by the City and the financial resources appropriated therefore by the City, the City shall provide educational and training opportunities for employee career growth. Each employee shall be responsible for utilizing those training and educational opportunities made available by the City or other institutions for the self- development effort needed to achieve personal career goals.
