Extended Disability Clause Samples

The Extended Disability clause defines the terms under which an individual, typically an employee or insured party, is considered to be continuously disabled beyond an initial period. It outlines the criteria for ongoing disability, such as the inability to perform job duties or any occupation, and specifies the duration and conditions for continued benefits. For example, after a set period of short-term disability, this clause may allow for long-term disability benefits if the individual remains unable to work. Its core function is to provide financial protection and clarity regarding benefit eligibility for prolonged or permanent disabilities, ensuring support for individuals facing extended health challenges.
Extended Disability. (a) If the contract or regular Faculty Member suffers an extended disability and is thereby unable to perform the assigned duties, the Faculty Member shall, upon exhaustion of paid sickness leave status as provided by Article 11, Section 3, be granted an unpaid extended disability leave. (b) The Faculty Member's request for such unpaid leave shall be accompanied by a physician's statement as to the necessity of such leave and the estimated duration of the disability. The District may at its expense require that the Faculty Member be examined by a physician selected by the District. In the event of a conflict in the findings of the two physicians, a third physician, mutually acceptable to the Faculty Member and the District shall be chosen and an opinion solicited. The cost of such examination by a third physician shall be paid by the District. (c) The period of such leave shall be determined by the medical condition of the Faculty Member and the needs of the instructional program. Any such extended disability leave shall not exceed a period of twelve (12) calendar months provided that such leave for a contract Faculty Member shall not exceed the end of the semester in which the disability occurs. The District may grant an extension or extensions beyond the period herein specified. Any such extension or extensions is subject to the requirements of subsection (b) of this Section.
Extended Disability. Employees may apply for and may be granted a leave of absence without pay for disability, including pregnancy complications, beyond paid sick time accrued. The employee must submit a satisfactory physician’s statement with such application at least two weeks prior to being granted the leave, except in cases of emergency. All such Disability Leaves of Absence require specific approval by the College and shall not exceed twelve (12) months in duration from the last day of paid leave.
Extended Disability. ‌ If the Officer is still disabled at the conclusion of all available paid disability leave(s) and is unable to return to work, Article 10, Section 2, Extended Disability Leave, shall apply.
Extended Disability. The Board shall advise each teacher to apply for extended disability benefits at least thirty (30) days (30) days in advance of her expected eligibility for such benefit. After ninety (90) consecutive calendar days of disability, the teacher shall apply for extended disability benefits and no further salary, group insurance plan premiums, or supplementation of employment insurance benefits shall be payable by the Board.
Extended Disability. If, at the conclusion of all industrial accident leave and additional leave, a classified employee is still unable to assume the duties of his/her position, he/she will be placed on a reemployment list for a period of 39 months.
Extended Disability. When an employee has no accrued sick leave available during an extended illness and he/she has exhausted all applicable FMLA leave, he/she may apply for and shall be granted an unpaid leave of absence without pay for disability beyond paid sick time accrued. The employee must submit a satisfactory physician’s statement with such application at least one week prior to being granted the leave, except in cases of emergency. All such Disability Leaves of Absence require specific approval by the College and shall not exceed twelve (12) months in duration from the last day of paid leave. During this period there will be no extension of fringe benefits except as provided by Family and Medical Leave Act (FMLA) and COBRA.
Extended Disability a. If a Contract or Regular Faculty Member suffers an extended disability and is thereby unable to perform the required duties as a Faculty Member, the Faculty Member shall, upon exhaustion of paid sick leave as provided in Section 14.4., be granted an unpaid extended disability leave.
Extended Disability. For the duration of the Superintendent’s performance of any duties herein, the Board shall pay the costs of covering the Superintendent’s enrollment in the long- term disability group coverage which is made available to School District employees.
Extended Disability. Leaves of Absence beyond regular sick days and accumulated unused sick leave and beyond the additional period(s) provided for in policy 3.01 (Article 3.00, Section 3.01 of the collective bargaining agreement), shall be available without pay for such reasonable further period of time as a teacher is determined by his/her physician to be disabled from performing the duties of his/her job by reason of such temporary disability, resulting from pregnancy or conditions attendant thereto. Requests for such leave should be made in writing to the Superintendent whenever an individual becomes aware of the need for such leave.
Extended Disability. 1. After all leave is exhausted, for a period not to exceed 5 months, the employee shall receive the difference between his/her pay and the sum actually paid to the substitute, until the employee qualifies for Income Protection Disability Insurance, at which time the actual daily salary paid the long-term substitute will be deducted from the employee's pay. 2. The District may require certification by the employee's carrier or physician, on a form provided by the District, that the employee is physically and mentally disabled and unable to perform his/her job.
