Extra Shift Premium. Full time and part time nurses who agree to work previously 30 unscheduled hours shall be paid their time-and-one-half rate for all extra hours worked, regardless 31 of the total number of hours worked in the work week or workday. The hospital may offer a nurse 1 an additional $10.00 per hour for all extra hours worked to encourage nurses to work hours/shifts 2 that are more difficult to fill. Casual nurses who agree to work previously unscheduled hours, with 3 less than seventy-two hours notice shall be paid one-and-one-half times the nurse’s applicable rate 4 of pay for all extra hours worked, regardless of the total number of hours worked in the work week 5 or work day. All extra shifts shall be so designated on the posted schedule. 1 APPENDIX B – ALTERNATIVE SHIFT SCHEDULES 3 1. This agreement shall cover nurses regularly assigned to twelve (12) hour shifts or ten (10) 4 hour shifts. Where otherwise mutually agreeable to the Hospital and a 2/3 majority of the affected 5 nurses on a nursing unit, a nurse may be scheduled for twelve (12), ten (10), or eight (8) hour shifts, 6 or some combination of such shifts, under the following conditions. 8 2. All other terms and conditions of the master Collective Bargaining Agreement shall apply 9 to affected nurses unless explicitly amended by this agreement. 11 3. This agreement shall remain in effect until amended or terminated by the following proce- 12 dure: 13 14 a. Should either administration or a two-thirds (2/3) majority of the affected nurses voting 15 by secret ballot wish to terminate this agreement, then the moving party shall give notice to 16 the other at least sixty (60) days prior to its intent to terminate or modify this agreement. 18 b. The parties shall meet at least once in order to attempt to negotiate the terms of a succes- 19 sor agreement. If no agreement is reached, then the status quo shall remain in place unless (1) administration notifies ONA that the agreement is terminated at the end of the notice pe- 21 riod, or (2) at least two-thirds (2/3) of the affected nurses vote by secret ballot to terminate 22 this agreement at the end of the notice period. 24 4. A nurse covered by this agreement shall be considered full-time if he or she regularly works 25 or is regularly scheduled to work 72 hours over a two (2) week period. Benefits for a part-time 26 nurse covered by this agreement shall be prorated by the percentage of regularly scheduled hours to 27 the full-time equivalent of 72 hours. 29 5. Overtime shall be compensated at the rate of 1-1/2 times of the nurse's regular rate of pay 30 inclusive of differentials for all work greater than the regularly scheduled shift for that work day 31 and/or 40 hours in a work week. 2 6. Each regularly scheduled nurse shall normally have an unbroken rest period of at least 10 3 hours between shifts, unless emergency conditions require such nurse to work longer periods to 4 meet adequate nursing care requirements. All time worked without a break of at least 10 hours at 5 the request of the Hospital shall be paid at the rate of 1-1/2 times the nurse's regular rate of pay. 7 7. Evening shift differential shall be paid for all hours worked between 1500 and 2300 hours 8 and night shift differential shall be paid for all hours worked between 2300 and 0700. 10 8. If a nurse is placed on-call or house-convenienced, he/she will work the remaining four (4) 11 hours to avoid losing a full 12-hour shift. If a nurse is put on-call and then called in to work for less 12 than nine hours of the scheduled on-call shift, the nurse shall receive time and one-half the applica- 14 work nine hours or more, he/she will be paid for 12 hours at the straight-time rate. This provision is 15 not intended to preclude the exercise of voluntary low-census or HC as per Article 16.9. 17 9. Three (3) 15-minute breaks and a one-half (1/2) hour unpaid meal break shall be permitted.

This section will apply only if the 12 nurse also works all of his/her scheduled shifts in the same pay period, 13 other than such shifts that were not worked because of a low census day 14 or because they had previously been scheduled as earned leave time off. 15 This premium will not be paid for any un-worked hours. This section 16 replaces all other premiums for working extra hours workedor unscheduled shifts that 17 may have been in existence before this section's effective date. 18 Once a nurse agrees to work an extra shift, regardless the nurse is committed to 20 which the nurse has signed up for extra shift(s), the extra shift differential 21 will be waived for the corresponding number of extra shifts that the total number nurse 22 misses. Further, a nurse is required to use accrued PTO for the missed 23 shift.
25 2. There will be no pyramiding of hours worked in under the work week 5 or work dayterms of this letter 26 of agreement. All (Example: If a nurse is paid the premium under this 27 section, the hours so paid will not be counted toward the computation of 28 weekly overtime.) No hour will be eligible for the payment of two such 29 premiums.
31 3. An apparently eligible nurse will be paid the extra shift premium for the 32 payroll period covering the hours worked. If it is subsequently determined 33 that the nurse was not eligible, the one-half premium amount will be 34 deducted from the nurse's pay for a subsequent payroll period.
1 4. If the nurse reduces his/her FTE status the extra shift differential will be 2 payable to the nurse only for extra shifts shall be so designated on worked after the posted schedulecompletion of 3 twenty-six (26) full pay periods following the nurse's FTE reduction. 1 APPENDIX B – ALTERNATIVE SHIFT SCHEDULES

(1) administration notifies ONA that the agreement is terminated at the end higher rate of the notice pe- 21 riod, or (2) at least two-thirds (2/3) of the affected nurses vote by secret ballot to terminate 22 pay during this agreement at the end of the notice period.

If extra shifts remain after the Medical Center has attempted to fill the 11 schedule with Per Diem nurses, the Medical Center will post the extra 13 be permitted to sign up for extra shifts for the first five (5) days that the 14 schedule is posted. Thereafter, all qualified nurses in the bargaining unit 15 may sign up. A nurse covered by this agreement shall be considered full-time if he or she regularly works 25 or may sign up for extra shifts; however, the Medical 16 Center may limit nurses to one hundred eight (108) hours in a pay period. 17 If the Medical Center is regularly scheduled concerned about patient care and safety, the 18 Medical Center reserves the right to work 72 hours over limit the number of extra shifts a 19 nurse may work.
21 6. If two (2) week periodor more nurses sign up for the same extra shift in the first seven 22 (7) days that the extra shifts are posted, the senior nurse prevails.
24 7. Benefits Per Diem nurses are not eligible for the extra shift premium.
26 8. Nurses who work an extra shift on Christmas Eve, Christmas Day, New 27 Years Day and Thanksgiving will be paid two (2) times the straight time 28 rate of pay so long as the holiday is not a part-time 26 result of trades.
30 9. Home Health Nurses: Telephone Consultation: Telephone consultation 31 (including documentation of telephone contact) that is necessary for the 32 guidance of personnel on duty, for telephone conferences, and/or for 33 patient evaluation or advice, and that is in excess of fifteen (15) 34 cumulative minutes while the nurse covered by this agreement is on call, shall be prorated by the percentage of regularly scheduled considered hours to 27 the full-time equivalent of 72 hours.
