Facility Assignments. The Employer shall solicit annually written expression of interest, in assignment to a particular courthouse/facility within the district where the Supervising Judicial Marshal is assigned, to become effective on the first day of the pay period that includes July 1. Each full time employee shall be provided with a bid sheet to indicate his/her preference for courthouse/facility, even if it is to remain in his/her current courthouse/facility. If the Supervising Judicial Marshal is not a work during the solicitation period, the Employer will make reasonable efforts to contact him/her to ascertain their expression of interest. Positions in the Supreme Court, the Appellate Court, and the Training Academy shall be exempt from this facility bidding procedure. When making annual assignments to courthouses/facilities, seniority shall govern, subject to predefined requirements and other legitimate operational issues, as determined by management, which shall be disclosed to the union. Seniority for the purpose of the annual bidding process shall be the length of continuous service as a Supervising Judicial Marshal. The Union may grieve and if necessary arbitrate a pattern of departures from seniority in making annual assignments under this paragraph without legitimate operational need. In situations where extenuating circumstances have created an operational deficiency requiring the filling of a facility assignment (for example, resignation, leaves of absence) outside of the bid period, the Chief shall make a temporary assignment, taking into consideration employee preferences expressed in the last annual bid, pending completion of the next bid period.
