Final Completion of the Work. (a) Upon receipt of written notice that the Work is ready for final inspection and acceptance and upon receipt of a final Application for Payment, the Project Manager and/or Architect/Engineer will promptly make such inspection and, when the Architect/Engineer finds the Work acceptable under the Contract Documents and the Contract fully performed, the Architect/Engineer will issue a final Certificate for Payment stating that to the best of the Architect/Engineer's knowledge, information and belief, and on the basis of the Architect/Engineer's on-site visits and inspections, the Work has been completed in accordance with terms and conditions of the Contract Documents and that the balance found to be due the Contractor and noted in the final Certificate is due and payable. The Architect/Engineer's final Certificate for Payment will constitute a further representation that conditions listed in Article 16.03(c) below as precedent to the Contractor's being entitled to final payment have been fulfilled. (b) Neither final payment nor any remaining retained percentage shall become due until the Contractor submits to the Architect/Engineer: (1) an affidavit that payrolls, bills for materials and equipment, and other indebtedness connected with the Work for which the Owner or the Owner's property might be responsible or encumbered (less amounts withheld by Owner) have been paid or otherwise satisfied in the form of affidavit included as Exhibit 8 (Contractor’s Affidavit of Payment of Debts and Claims); (2) a certificate evidencing that insurance required by the Contract Documents to remain in force after final payment is currently in effect and will not be canceled or allowed to expire until at least 30 days' prior written notice has been given to the Owner; (3) a written statement that the Contractor knows of no substantial reason that the insurance will not be renewable to cover the period required by the Contract Documents; (4) consent of surety, if any, to final payment; (5) submission of signed and notarized Conditional or Unconditional Waiver and Release on Final Payment forms (Exhibit 6.3 or Exhibit 6.4 as appropriate); (6) and, if required by the Owner, other data establishing payment or satisfaction of obligations, such as receipts, releases and waivers of liens, Claims, security interests or encumbrances arising out of the Contract, to the extent and in such form as may be designated by the Owner. Final Completion of the Work. The Work shall be commenced on the date stated in the initial Notice to Proceed issued by the District to the Contractor and shall be completed within forty-five (45) consecutive calendar days from the date stated in the initial Notice to Proceed. Final Completion of the Work or identified portions of the Work shall be achieved as expeditiously as reasonably practicable. Final Completion is the date when all Work is complete pursuant to the definition of Final Completion set forth in Section 1.2.7 of the General Conditions of Contract.
Final Completion of the Work. The Work shall be deemed finally completed (“Final Completion”) when (a) the conditions for Substantial Completion have been met, (b) all Punch List items have been substantially completed as certified by the Architect, and (c) Landlord has delivered to Tenant (i) all operating manuals for machinery and equipment, (ii) all warranties issued by vendors and material and equipment manufacturers required hereunder to be delivered by Landlord, (iii) copies of all permits obtained by Landlord, (iv) all as-build drawings for the Building, and (v) copies of the final waiver or release of liens from the Design Builder.
Final Completion of the Work. Final completion of the work shall be achieved within FIVE HUNDREND TEN (510) CONSECUTIVE CALENDAR DAYS beginning Monday October 7, 2019 and ending Saturday February 28, 2021. Failure to achieve Final Completion within the Contract Time will result in the assessment of Liquidated Damages.
Final Completion of the Work. 18.1 At the expiration of the Term of this Contract, Owner will carry out an inspection of the Work. The Work performed hereunder may be accepted as a whole or in separately defined parts. If all of the Work has been completed to the satisfaction of Owner, Owner will provide written notice to Contractor ("Notice of Completion"). In the event the notice includes only a portion of the Work, the notice will contain a list of items that must be completed in order to reach Final Completion. The Final Completion period may extend past the end of the Term so as to allow Contractor to remedy any issues described by the Owner in its partial notice. In the event that Contractor disagrees with the items listed, Contractor may exercise its rights as defined elsewhere in this Contract.

Related to Final Completion of the Work

  • Completion of the Work The Contractor must obtain Material Completion as defined in Section 6.1.2 below prior to any occupancy of the Project.
