The Flood Control clause establishes the responsibilities and procedures related to managing and mitigating flood risks on a property or project site. Flood Control. Nothing in this Agreement affects or alters the obligations, rights, and privileges of the entities under the Treaty relating to operation and compensation for flood control and without restricting the generality of the foregoing, it is expressly agreed that any reduction in generation in the United States brought about by operation for flood control under the Treaty or any flood control arrangements made pursuant to the Treaty shall not be a reduction in the Canadian Entitlement for which compensation is required under this Agreement.
Flood Control. Each Loan Party, the Real Property Collateral and the use and operations of the Real Property Collateral are in compliance in all material respects with the provisions of all flood control laws, ordinances and other regulations applicable to the Real Property Collateral (including laws, ordinances and regulations of the C▇▇▇▇ County Flood Control District) and all agreements relating to flood control with respect to the Real Property Collateral.

Flood Control. For flood control operation, the United States entity will submit flood control operating plans which may consist of or include flood control storage reservation diagrams and associated criteria for each of the dams. The Canadian entity will operate in accordance with these diagrams or any variation which the entities agree will not derogate from the desired aim of the flood control plan. The use of these diagrams will be based on data obtained in accordance with paragraph 2. The diagrams will consist of relationships specifying the flood control storage reservations required at indicated times of the year for volumes of forecast runoff. After consultation with the Canadian entity the United States entity may from time to time as conditions warrant adjust these storage reservation diagrams within the general limitations of flood control operation. Evacuation of the storages listed hereunder will be guided by the flood control storage reservation diagrams and refill will be as requested by the United States entity after consultation with the Canadian entity. The general limitations of flood control operation are as follows:
Flood Control. The Parties agree that the Licensee pursuant to proposed Article A130, will comply with the rules and regulations prescribed by the U.S. Army Corps of Engineers. The Parties reserve the right to present evidence or argument relative to the impacts posed by any flood control proposal raised by any intervenor or otherwise before the Commission or the U.S. Army Corps of Engineers.
Flood Control. Construction, and operation and maintenance (“O&M”), by DSI, of flood control structures (primarily new construction, and secondarily rehabilitation, of said structures) to mitigate flood risks in selected river basins and to improve flood risk management through an optimal combination of structures (including, inter alia, check dams, levees, retaining walls, embankments, reservoirs, polders) in flood-prone areas (“Sub-projects”); said Subproject activities include
(i) construction of check dams, permeable check dams, levees, culverts, flood control channels, reinforced concrete channels, open channels with trapezoidal cross-section, open channels with retaining walls, and railings, (ii) piloting of nature-based solutions (“NBS”) (including the use of flood plains and bypasses, inland wetlands, stream banks and beds, and upland forest) and hybrid NBS and conventional grey solutions, and (iii) implementing innovative techniques for flood management at river basin scale.
Flood Control a. Installation of flood or rain gauges that use existing distribution systems, facilities, or existing infrastructure rights-of-way --DRAFT--
b. Installation of flood or rain gauges in previously developed urban complexes when the work does not require modification of buildings, structures 45 years or older, is not within 500 feet of the boundaries of a historic property and occurs within previously disturbed soil or adjacent to streams where the gauge hole does not disturb an area greater than 10' x 10'. NOTE: This allowance does not apply to installation of related facilities, such as stilling ▇▇▇▇▇ or job boxes, unless in previously disturbed soils, nor to work proposed in inactive cemeteries, burial grounds, previously recorded archaeological sites, archaeologically sensitive areas, historic landscapes, and sites of significance to Tribes.
Flood Control. Any employee from Flood Control required to perform storm water sampling to meet regulatory permit mandates or required to work during a storm event and/or other emergency, who are asked and/or required by the Department Head or their designee to work extra shifts and/or hours beyond their regular shift pattern, shall be paid at one and one half (1½) their base rate of pay for such time worked.
Flood Control. It is understood that any agreement reached in this article must be incorporated into the USACE ▇▇▇▇ Dam operating policies. The USACE retains full authority to support its primary flood control mission.
