Floor Area. The Purchaser acknowledges and agrees that the floor area or square footage of the House is determined by the Vendor’s surveyor or architect and that from and after February 1, 2021 is calculated in accordance with the NHCLA and regulations, bulletins, guidelines and other informational material prepared by the HCRA. It is acknowledged and agreed by the Purchaser that the dimensions, floor area or square footage of the House, as represented to the Purchaser in any sales brochure, sketch, floor plan, or other marketing or advertising material is approximate, is not the same and may differ from the actual size and defined boundaries of the House, and the Purchaser consents to same. The Purchaser is further advised that the actual usable and liveable floor space may vary from any stated floor area. Accordingly, the Purchaser hereby confirms and agrees that all details and dimensions of the House are approximate only and that the Purchase Price shall not be subject to any adjustment or claim or compensation whatsoever, whether based upon the ultimate square footage of the House or the actual usable or liveable space within the confines of the House or the net floor area of the House, or otherwise, regardless of the extent of any variance or discrepancy in or with respect to the area of the House or dimensions thereof. Floor Area. As used in this Lease, “Floor Area” means all areas designated by the Landlord for the exclusive use of a tenant, as measured from the exterior surface of exterior walls and from the center of interior demising walls, and includes restrooms, mezzanines, warehouse or storage areas, clerical or office areas and employee areas and break rooms. (b) In determining the gross leasable floor area or the gross leased and occupied floor area of the Shopping Center for the purposes of calculating Tenant’s proportionate share in the manner provided in Section 2.05 of this Lease, there shall be excluded therefrom, at the sole option of Landlord, the leasable area of twenty thousand (20,000) square feet or more occupied by a single entity (which, for purposes of this Lease, shall be defined as an anchor store), the floor area of any premises leased for the operation of a post-office type or packaging or delivery facility or other public/consumer-service or governmental facility, the floor area of any space without direct customer access from the enclosed mall, if any, and the total floor area utilized by Landlord for the operation of a management office, theater, skating rink or other recreational area, child care center, community room, library, project offices, and related rooms, Common Areas and project areas, which shall be deemed amenities to the Shopping Center. The term “gross leased and occupied floor area” shall include only such areas as are leased and occupied by tenants subsequent to the dates of commencement of the terms of their respective leases. Floor Area. Ground Floor Area" as used in this Lease means, with respect to the Premises and with respect to each store area separately leased, the aggregate of (a) the number of square feet of floor space on the ground floor level, measured from the exterior faces of exterior walls and the center of party walls, and (b) all outside selling areas used exclusively by any tenant for the sale of merchandise.
