Form of Contract. The form of contract for this solicitation shall be the Request for Proposal, the awarded proposal(s) and best and final offer(s), and properly issued and reviewed purchase orders referencing the requirements of the Request for Proposals. If a firm submitting an offer requires Region 4 ESC and/or Member to sign an additional agreement, a copy of the proposed agreement must be included with the proposal.

Identify directly from the Framework the most capable Contractor; hold a mini-competition between all Contractors deemed capable of meeting the need for a specific assignment in order to establish which supplier provides the “most economically advantageous” offer based on award criteria; Operate a carousel / rota system 3.7 Should there be a mini-competition stage, evaluation criteria will often carry different weightings to those used at the Tender stage. Contractors will be allowed on viewing any extra detail provided at this stage to offer a discount on their standard Framework Rate in order to be competitive. 3.8 The Client shall be entitled, but not obliged, at any time during the term of the Framework Agreement to order services from the Contractor. Tendered rates and charges will be the maximum applicable for the full framework term.
