FULLY BARGAINED CLAUSE Sample Clauses

A Fully Bargained Clause affirms that all terms and conditions within the agreement have been thoroughly negotiated and mutually agreed upon by the parties involved. This clause typically applies to contracts where both sides have had the opportunity to review, discuss, and modify the terms, ensuring that no provision is considered one-sided or imposed without consent. Its core practical function is to prevent either party from later claiming that a term was unfairly included or not properly discussed, thereby reducing the risk of disputes over contract interpretation or enforceability.
