Fund Availability and Annual Appropriation Clause Samples

The Fund Availability and Annual Appropriation clause establishes that the fulfillment of contractual obligations is contingent upon the availability of funds appropriated by the relevant government authority for each fiscal year. In practice, this means that if the necessary funds are not allocated or become unavailable in future budget cycles, the government may reduce or terminate its commitments under the contract without penalty. This clause is essential for managing financial risk and ensuring that government agencies do not commit to expenditures beyond their legally authorized budgets.
