The General Description of Land Use clause defines the permitted uses and activities that may take place on a specific parcel of land. General Description of Land Use. The use(s) of the Lands permitted by this Agreement, subject to its terms and as generally illustrated on the Schedules attached hereto, are the following:
(a) Non-residential uses permitted by the C-2A (Minor Commercial) Zone, except for service stations and billboards;
(b) An apartment house (multiple-unit residential uses); and
(c) Uses accessory to any of the foregoing uses.
General Description of Land Use. 3.3.1 The use(s) of the Lands permitted by this Agreement are a maximum of 56 main dwelling units as identified on Schedule B, including the following:
(a) Single unit dwellings;
(b) Two-unit dwellings;
(c) Secondary and backyard suites, in conformance with the applicable Land Use By-law;
(d) Home occupation uses in conjunction with permitted dwellings, in conformance with the applicable Land Use By-law;
General Description of Land Use. The use(s) of the Lands permitted by this Agreement are the following:
(a) Non-residential uses permitted by the C-2A (Minor Commercial) Zone, with the exception of a bowling alley, motion picture theatre, service station, billboard, and commercial recreation uses;
(b) A lounge in conjunction with a permitted restaurant;
(c) One (1) dwelling unit on the ground-floor;
(d) An apartment house (multiple-unit residential uses); and
(e) Uses accessory to any of the foregoing uses.
General Description of Land Use. 3.2.1 The uses of the Lands permitted by this Agreement are the following:
a) A mobile home park to a maximum of 525 mobile homes; and
b) Uses permitted within the Mobile Home Park By-law.
General Description of Land Use. 3.3.1 The use(s) of the Lands permitted by this Agreement are the following:
(a) a child care centre at ▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇ Road for not more than 40 children occupying the existing building;
(b) a child care centre at ▇ ▇▇▇▇▇▇▇▇▇ ▇▇▇▇ for not more than 40 children occupying the existing building; and
(c) any use within the R-1 (Single Family Dwelling) zone, subject to the provisions contained within the Land Use By-law for Halifax Mainland.
3.3.2 The Development Officer may permit unenclosed structures attached to the main buildings such as verandas, decks, porches, steps, and mobility disabled ramps to be located within the required minimum front, side and rear yards in conformance with the provisions of the Land Use By-law for Halifax Mainland, as amended from time to time.
3.3.3 One (1) accessory building in accordance with the requirements of the Land Use By-law for Halifax Mainland, as amended from time to time, is permitted on each property on the Lands.
3.3.4 Should a main building be destroyed or demolished, wholly or in part, the following shall apply:
(a) reconstruction as a detached one-family dwelling within the R-1 Zone is permitted on each lot subject to the provisions contained within the Land Use By-law for Halifax Mainland;
(b) use as a child care centre (day care facility) may continue subject to 3.3.1(a) or (b) in accordance with this Agreement; or
(c) upon granting of an occupancy permit, the new main building shall be deemed the existing building.
3.3.5 The Lands may not be consolidated.
3.4.1 Alterations to the exterior of the buildings shall be subject to the R-1 (Single Family Dwelling) Zone standards contained within the Land Use By-law for Halifax Mainland and shall not be such that the buildings no longer appear to be residential in nature, in the opinion of the Development Officer.
3.4.2 Nothing in this Agreement shall prevent facilities for physically challenged children or playground equipment from being erected on the property.
General Description of Land Use. 3.3.1 The use(s) of the Lands permitted by this Agreement are the following:
(a) On Lot 1:
(i) The existing shopping centre that may contain the following uses: i. Stores for the purpose of retail trade and rental excepting:
1. Motor vehicle dealers;
2. Motor vehicle repair shops which such shops are not primarily engaged in providing service station facilities; and
3. Adult entertainment uses except where expressly permitted above.
General Description of Land Use. 3.3.1 The use(s) of the Lands permitted by this Agreement are the following:
(a) An eight storey multi-unit residential building;
(b) Underground parking in the multi-unit building; and
(c) Uses accessory to any of the foregoing uses.
General Description of Land Use. 3.3.1 The uses of the Lands permitted by this Agreement is a multiple unit residential building with commercial uses.
3.3.2 The total number of residential units shall not exceed 35 units and a minimum of one third of the residential units shall have a floor area of 74.3 square metres (800 square feet) or larger.
3.3.3 The following are permitted commercial uses:
(a) Grocery Store;
(b) Drug Store;
(c) Commercial Parking Lot; and
(d) personal service uses.
3.3.4 Commercial uses shall be located at the ground level, with the exception of the commercial parking lot, which shall be located underground.
General Description of Land Use. 3.3.1 The use(s) of the Lands permitted by this Agreement are the following:
(a) Gas Bar and Convenience Store; and
(b) Accessory uses to the forgoing.
General Description of Land Use. 3.2.1 The use(s) of the Lands permitted by this Agreement are the following:
(a) Any uses permitted within the existing zone applied to the Lands subject to the provisions contained within the Land Use By-law for Planning Districts 14 and 17 as amended from time to time.
(b) Subject to the terms of this agreement, the following additional uses are permitted: ▪ Parking Lot ▪ Building Supply Outlet ▪ Warehousing ▪ Wholesale operations ▪ Service Industry not including heavy equipment repair, auto body repair shop, truck depot or paint shop ▪ Service and repair of automobiles ▪ Light manufacturing, assembly uses which are not obnoxious.
3.2.2 The Development Officer may permit unenclosed structures attached to a main building such as verandas, decks, porches, steps, and mobility disabled ramps to be located within the required minimum front, side and rear yards in conformance with the provisions of the Planning Districts 14 and 17 Land Use By-law, as amended from time to time.
3.2.3 All uses shall be conducted and wholly contained within a building or accessory building.
