Grant Positions. In most cases, an awarded grant will already have identified those faculty members who shall undertake additional duties under the grant based upon their unique qualifications for the duty. In those situations the identified faculty will be awarded the additional assignment and associated compensation specified in the grant. The Association will be notified and the assignment published. Section 13.8.1 In those cases where the grant will award extra duty contracts to unit members not already identified, then the procedures outlined in the grant for the selection of those individuals will justify and define the positions and compensation but the positions will be subject to the provisions of Article XIII of this agreement. Section 13.8.2 When such procedures or qualifications are not explicitly stated in the grant, the provisions of this Article will apply.
Grant Positions. Many of the positions of employment covered by this Agreement are funded by either a Federal Grant, reimbursement by the State of Michigan, or a special fund with the Health Department budget. In the event that the funds being currently provided are terminated, all the positions funded by that source would be eliminated and lay offs will occur as provided in Section 4 below. Laid off grant employees may exercise contract bumping rights as provided in this Article. However, employees may not bump into a grant position unless they meet all grant requirements. The MNA will be notified in writing prior to any termination or layoff.
Grant Positions. Grant positions are defined as positions that have alternate funding from sources outside of the Public Health Trust. Grant positions are typically funded for specific periods of time and for specific amounts of money that cover wages and benefits. Grant positions can be full-time (scheduled for 40 hours per week) or part-time (scheduled for 30 to 35 hours per week or scheduled for under 30 hours per week). The seniority and status of employees in classifications covered by this collective bargaining agreement shall be unaffected by the source of funding, whether by grant or otherwise. As such, grant funded employees shall be provided with the same rights as all other employees covered by this collective bargaining agreement. Permanent full-time employees who have been voluntarily or involuntarily assigned to grant positions that are later eliminated due to loss of funding shall be transferred to comparable positions in accordance with Public Health Trust policy and this collective bargaining agreement. Such employees shall not be required to serve a new probationary period.
Grant Positions a) Temporary employees filling Grant positions are hired for three (3) months or more pursuant to specific projects being undertaken when the Employer applies for and receives, grant moneys from Government, Foundations, etc. or; Where United Way grants the money on a limited basis to test a new position for a period not to exceed twelve (12) months and where the position continues beyond twelve (12) months, it will become a Regular Full Time, or Regular Part Time position within the bargaining unit and will be posted in accordance with Article 16. All projects will have a definite start and termination date and will be discussed in advance at a Labour/Management Committee meeting. b) i) Temporary employees filling Grant positions which will be in effect for longer than two (2) years have, at the completion of three (3) months employment, the one time irrevocable option of receiving either twelve percent (12%) on each pay period in lieu of vacation and benefits (as per Article 2.07 (j)), or: receiving six percent (6%) on each pay period and being enrolled in the Extended Health Benefits (Article 24.04 (b) – Letter of Understanding #1: Part 1 only), Dental Plan (Article 24.03), and Medical Insurance (Article 24.04 (a)) in lieu of vacation and benefits.
Grant Positions. Full-time and/or Part-time Employees who are a member of the bargaining unit and accept a grant position in accordance with the procedure described in Clauses 19.02, 19.03 and 19.04 above, the Employee shall: (a) retain all seniority rights accumulated prior to the commencement of the grant position; (b) continue to accumulate seniority during the period that they are in the grant position; (c) receive pay and benefits in accordance the collective agreement including being permitted to continue to participate in the group benefit plans as provided under Article 34, in which they were enrolled prior to acceptance of the grant position; (d) in cases where the grant position has a clear start and end date, return to their former position on completion of the grant position. In cases where the grant position does not have a clear end date, the Employee shall be able to return to their former position at any time within 24 months of accepting the grant position provided the Employer receives at least four (4) weeks notice from the Employee that they wish to return to their former position.

Notwithstanding the provisions of Article 17.16, in In those cases where the grant will award extra duty contracts to unit members not already identified, then the procedures outlined in the grant for the selection of those individuals shall prevail. When such procedures or qualifications are not explicitly stated in the grant, all positions must be advertised to all unit members via the campus email system for a minimum of five (5) business days prior to the position being assigned and all unit members must have an opportunity to apply.

  • The Board (a) The Board may, subject to the provisions of paragraphs (a) and (b) of this Section 2.6 with respect to the number of and vacancies in the position of Director and the provisions of Section 3.3 hereof with respect to the election of Directors by Members, designate any person who shall agree to be bound by all of the terms of this Agreement as a Director. The names and mailing addresses of the Directors shall be set forth in the books and records of the Company. The number of Directors shall be fixed from time to time by a written instrument signed by, or by resolution approved at a duly constituted meeting by vote of, a majority of the Board, provided however that the number of Directors shall at all times be at least one and no more than ten as determined, from time to time, by the Directors pursuant to this Agreement. (b) Each Director shall serve as a Director for the duration of the term of the Company, unless his or her status as a Director shall be sooner terminated pursuant to Section 4.2 hereof. If any vacancy in the position of a Director occurs, the remaining Directors may appoint a person to serve in such capacity, provided that, at any time the Company is registered under the Company Act, such appointment is in accordance with the Company Act. The Directors may call a meeting of Members to fill any vacancy in the position of Director, and shall do so at any time the Company is registered under the Company Act and such meeting is required by the Company Act. (c) In the event that no Director remains to continue the business of the Company, the Investment Manager shall promptly call a meeting of the Members, to be held within 60 days after the date on which the last Director ceased to act in that capacity, for the purpose of determining whether to continue the business of the Company and, if the business shall be continued, of electing the required number of Directors to the Board. If the Members shall determine at such meeting not to continue the business of the Company or if the required number of Directors is not elected within 60 days after the date on which the last Director ceased to act in that capacity, then the Company shall be dissolved pursuant to Section 6.1 hereof and the assets of the Company shall be liquidated and distributed pursuant to Section 6.2 hereof.
