ICE CONDITIONS. When a Tug is operating under “ice conditions” there will be an additional charge equal to fifty percent (50%) of the applicable Hourly Rate, computed in increments of one-half hour, any fraction thereof to be charged at full one-half hour. As used herein, the term “ice conditions” shall mean the presence of ice at berths or anchorages or of ice flow or ice in transit that exceeds four
ICE CONDITIONS. When a Tug is operating in ice conditions, when providing any Tug Services, the charge will be 50 percent above the applicable rate shown on this schedule. Greater than 25,000NRT, each 2,500-ton increment or portion, add an additional $400 to Docking or Undocking Rate.
ICE CONDITIONS. For Tug services running through or assisting through ice, in addition to the applicable charge, there shall be a charge of $440.00 per hour per Tug, including running time from the Tug Station to the Vessel assisted and from the Vessel assisted to the Tug Station.
ICE CONDITIONS. A rate of $2,750 per Tug per hour pro-rated for part of an hour, including running time to and from its Tug Station, shall apply for services requested. Hourly rates are subject to Holiday rate provisions.
ICE CONDITIONS. When a Tug is operating in ice conditions, when providing any Tug Services, the charge will be 50 percent above the applicable rate shown onthis schedule.
ICE CONDITIONS. When a Tug providing services to a Vessel is operating in ice conditions, the rate charged for that Tug shall be increased by fifty percent (50%) over the applicable rate and /or hourly rate set forth herein. When it is necessary for a Tug to break ice in connection with docking or undocking a Vessel, or to clear an ice bound slip for any reason, said service will be charged at an hourly rate of $3,575.00 per Tug, measured from Tug station to Tug station. No running time will be charged if the Tug used to break ice is also used in the Docking and Undocking operation. The hourly rate applicable to ice breaking will be pro-rated to the nearest half (1/2) hour.
ICE CONDITIONS. When a Tug providing services to a Vessel is operating in ice conditions, the rate charged for that Tug shall be increased by fifty percent (50%) over the applicable rate and /or hourly rate set forth herein. When it is necessary for a Tug to break ice in connection with docking or undocking a Vessel, or to clear an ice bound slip for any reason, said service will be charged at an hourly rate of $3,300.00 per Tug, measured from Tug station to Tug station. The hourly rate applicable to ice breaking will be pro-rated to the nearest half (1/2) hour.

  • Unsafe Conditions In accordance with 29 CFR § 1977, occasions might arise when an employee is confronted with a choice between not performing assigned tasks or subjecting himself/herself to serious injury or death arising from a hazardous condition at the workplace. If the employee, with no reasonable alternative, refuses in good faith to expose himself/herself to the dangerous condition, he/she would be protected against subsequent discrimination. The condition causing the employee's apprehension of death or injury must be of such a nature that a reasonable person, under the circumstances then confronting the employee, would conclude that there is a real danger of death or serious injury and that there is insufficient time, due to the urgency of the situation, to eliminate the danger by resorting to regular statutory enforcement channels. In addition, in such circumstances, the employee, where possible, must also have sought from his Employer, and been unable to obtain, a correction of the dangerous condition.

  • Subsurface Conditions Unless the Contract Documents stipulate specific quantities and units of rock or unsuitable soils, the Contractor shall assume material below the surface of the Earth to be earth and other material that can be removed by power shovel or similar equipment. Should conditions encountered below the surface of the ground be at variance to the number of unit requirements as indicated by drawings or specifications, and absent an agreed-upon unit price established prior to the bid by Addendum, or after contract execution by Change Order, the Contract Sum and/or time shall be adjusted as provided in the Contract Documents for changes in the work.
