Inspection Required. The Landowner, its successors and assigns, shall regularly and periodically inspect the Facility in its entirety. Records shall be kept to identify the dates and maintenance performed and shall be made available to the County at the County’s request. The inspection shall cover all parts of the Facility including, but not limited to, berms, outlet structures, pond areas, and access roads. The Landowner’s failure to inspect shall be treated as a breach of this Agreement just as much as a failure to repair if repair is needed after inspection.

As soon as all pipe work from the public sewer to inside the building has been completed, and before any backfilling is done, the Inspector shall be notified and the ▇▇▇▇▇▇ County Environmental Health Department or their authorized representative shall inspect and test the work as to workmanship and material; no sewer pipe laid under ground shall be covered or trenches filled until after the sewer has been so inspected and approved. If the Inspector refuses to approve the work, the plumber or owner must proceed immediately to correct the work. If the plumber or the owners fail to immediately correct work, the bond shall be held liable to correct the work at the direction of the Sanitarian.

The Landowner grants permission to the Town, its authorized employees and agents, to enter upon the Property and to inspect the Facility whenever the Town deems necessary. The purpose of the inspection is to follow‐up on reported or observed deficiencies, to respond to citizen complaints, or to inspect if a significant time has passed after the last inspection. The Town shall provide the Landowner a copy of the inspection findings and a directive to commence with the repairs if necessary. In the case of multiple Landowners of a single property, notice to one shall suffice as notice to all.

Those records shall be made available to the County upon request. The Landowner’s failure to inspect, maintain, or repair the Facility shall constitute a breach of these covenants.
