Common use of Launch Services Clause in Contracts

Launch Services. Purchaser shall be responsible for furnishing Launch Services for the Satellite and Purchaser shall no later than twelve (12) months prior to Delivery of the Satellite, notify Contractor of its selection of the Launch Vehicle for the Launch of the Satellite. The Launch Vehicle shall be one of the candidate Launch Vehicles identified in Paragraph 2.1 (Launch Requirements) of Exhibit B, Satellite Performance Specification, and the Launch Date shall be compatible with the Satellite Delivery schedule set forth in Article 3.1 hereof.

Launch Services. Purchaser shall be responsible for furnishing Launch Services for the Satellite; provided, however, Purchaser shall not be obligated to Launch the Satellite and may elect to store the Satellite pursuant to Article 39 or make other arrangements per Article 16. Purchaser shall shall, no later than twelve (12) months prior to Delivery the expected Launch date for an Arianespace 5 Launch Vehicle or, for any other Launch Vehicle, the lesser of (i) eighteen (18) months prior to the expected Launch date or (ii) the notification period that is required to meet the requirements of the Satellitealternative Launch Agency, notify Contractor of its selection of the Launch Vehicle for the Launch of the Satellite. The Launch Vehicle shall be one of the candidate Launch Vehicles identified in Paragraph paragraph 2.1 (Launch Requirements) of Exhibit B, Satellite Performance Specification, and the Launch Date shall be compatible with the Satellite Delivery schedule set forth in Article 3.1 hereof.
