After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining work within the time specified in the Contract Documents for Final Completion and readiness for final payment or any proper extension thereof granted by City, Contractor shall pay City, as liquidated damages and not as a penalty, additional sum of TWO HUNDRED AND NO/100 DOLLARS ($200.00)per 200) per day for each calendar day of unexcused delay in achieving completion and readiness for final payment.

In no event shall liquidated damages exceed FIVE PERCENT (5%) of the purchase price of the unit for which delivery has been delayed.

After Substantial Completion, if Contractor Vendor shall neglect, refuse, or fail to complete the remaining work within the time specified in the Contract Documents for Final Completion and readiness for final payment or any proper extension thereof granted by City, Contractor Vendor shall pay City, as liquidated damages and not as a penalty, additional sum of TWO HUNDRED TWENTY-FIVE AND NO/100 DOLLARS ($200.00)per 25) per day for each calendar day of unexcused delay in achieving completion and readiness for final payment.

After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining work Work within the time specified in the Contract Documents for Final Completion and readiness for final payment or any proper extension thereof granted by City, Contractor shall pay City, as liquidated damages and not as a penalty, additional sum of TWO ONE HUNDRED AND NO/100 DOLLARS ($200.00)per 100.00) per day for each calendar day of unexcused delay in achieving completion and readiness for final payment.

LIQUIDATED DAMAGES FOR LATE COMPLETION. The parties agree that it would be extremely difficult and impracticable under the presently known facts and anticipated circumstances to ascertain and fix the actual damages that City and its residents would incur should Contractor fail to achieve Substantial Completion and/or Final Completion and readiness for final payment by the dates specified for each individual project under the terms of this Agreement. Accordingly, the parties agree that should Contractor fail to achieve Substantial Completion by the dates date specified on each City-issued Notice to Proceed, then Contractor shall pay City, as liquidated damages and not as a penalty, the daily sum given in the schedule below based on individual project cost TWO HUNDRED AND NO/100 DOLLARS ($200.00) for each calendar day of unexcused delay in achieving Substantial Completion beyond the date specified for Substantial Completion for each individual project in the City- City-issued Notice to Proceed: . After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining work Work within the time specified in the Contract Documents for Final Completion and readiness for final payment or any proper extension thereof granted by City, Contractor shall pay City, as liquidated damages and not as a penalty, an additional sum of TWO HUNDRED FIFTY AND NO/100 DOLLARS ($200.00)per 50) per day for each calendar day of unexcused delay in achieving completion and readiness for final payment.

After Substantial Completion, if Contractor shall neglect, refuse, or fail to complete the remaining work within the time specified in the Contract Documents for Final Completion and readiness for final payment or any proper extension thereof granted by City, Contractor shall pay City, as liquidated damages and not as a penalty, additional sum of TWO HUNDRED AND NO/100 DOLLARS ($200.00)per 200) per day for each calendar day of unexcused delay in achieving completion and readiness for final payment.
