Management and Maintenance of the Project a. The Owner shall provide for the management of the Project in a manner satisfactory to the Secretary. Any management contract entered into by the Owner involving the Project shall contain a provision that it shall be subject to termination, without penalty and with or without cause, upon written request by the Secretary addressed to the Owner. Management and Maintenance of the Project. (i) The PROMOTER shall be responsible to provide and maintain essential services of the Project till the taking over of the maintenance thereof by the Association of the Allottees upon issuance of Completion Certificate of the Project. (ii) Until the Association of Allottees takes over the management and maintenance of the Common Areas and Facilities of the Project, the Promoter shall maintain the same for the consideration and subject to the terms and conditions set out below: (a) Property Care Service Ltd. (“PCSL”), a Company engaged in the business of maintenance and management of the properties, has been appointed by the Promoter/Developer for maintaining the Common Areas and Facilities of the Project, (hereinafter referred to as “the Maintenance Agency”) on and from the date of possession, the Allottees shall be liable to pay to the Maintenance Agency the Applicable Maintenance Charges of the Country Home allotted to him within 7 days of receipt of Monthly Invoice for such maintenance charges from the Maintenance Agency. (b) Maintenance Security Deposit: Every allottee, on or before taking possession of the Country Home, will be required to pay an interest free security deposit @ Rs. 30 (Thirty) per sq.ft. of the carpet area of the respective country home. The Promoter/Developer reserves the right to utilize this deposit to adjust any legally realizable dues from the allottee. The interest free deposit, after adjustment of dues, if any, will be transferred to the Association of Allottees at the time it takes over the maintenance of the Common Areas. (c) Maintenance Charge: The initial monthly maintenance charges will be @ Rs 2/- (Two rupees) per sq.ft. of the carpet area of the Country Home and Rs 0.75 (Seventy-five paisa) per sq.ft. of the plot area of the Country Home excluding the payment of applicable taxes (collectively the ‘MAINTENANCE CHARGES’). The Maintenance Charges shall be subject to increase after 1 year from the date of possession of the Country Home by the Allottee on an annual basis, depending upon the increase in costs of various inputs.

Related to Management and Maintenance of the Project

  • Repairs and Maintenance (a) Tenant shall keep the Premises, including the Leasehold Improvements and Tenant's Property (both as hereinafter defined) neat, clean and in good order and condition. Tenant shall give Landlord prompt notice of any damage to or defective condition in any part or appurtenance of the Premises, the Leasehold Improvements, Tenant's Property, or the Building (including mechanical, electrical, plumbing, heating, ventilating, air conditioning and other equipment facilities and systems located within or serving the Building, collectively sometimes hereinafter referred to as the "Building Systems"). Tenant shall be responsible for (i) all repairs, replacements and alterations in and to the Premises, the Leasehold Improvements and Tenant's Property, and (ii) for all repairs, replacements and alterations in and to the Building and the Building Systems, the need for which arises out of (A) Tenant's use or occupancy of the Premises; (B) the installation or use of Tenant's Property in the Premises; (C) the moving of Tenant's Property into or out of the Building; or (D) any other act or omission of Tenant or Tenant's Representatives; provided, -------- however, that such repairs, replacements or alterations (other than to Tenant's ------- Property) shall be made by Landlord and Tenant shall pay Landlord within ten (10) days of demand the cost therefor as determined by Landlord, plus 7% for Landlord's overhead and profit. Landlord may, before commencing any such work or at any time thereafter, require Tenant to furnish to Landlord such security in form (including a bond issued by a surety satisfactory to Landlord) and amount as Landlord shall deem necessary. (b) Tenant shall not place a load upon any portion of the floor of the Premises which exceeds the load per square foot which such floor was designed to carry. (c) Tenant shall not install business machines or mechanical equipment which cause noise or vibration that may be transmitted to the structure of the Building. (d) Landlord (except as provided in subsection 9(a)) shall; at Landlord's expense, repair, replace and maintain the external and structural parts of the Building which do not constitute a part of the Premises and are not leased to others, and shall perform such repairs, replacements and maintenance in a good and workmanlike manner and using commercially reasonable efforts to minimize disruption to Tenant's business operations and access to the Premises. (e) Except to the extent caused by the gross negligence of Landlord and except as otherwise provided herein, Landlord shall have no liability to Tenant nor shall Tenant's covenants and obligations under this Lease be reduced or abated in any manner whatsoever by reason of any inconvenience, annoyance, interruption or injury to business arising from Landlord's making any repairs or changes which Landlord is required or permitted by this Lease or by any other tenant's lease or required by law to make in or to any portion of the Premises, the Building or the Building Systems. Landlord shall use its best efforts to minimize any interference with Tenant's business in the Premises on account of Landlord's making of such repairs or changes.

  • Operation and Maintenance 17.1 O&M obligations of the Concessionaire 17.1.1 During the Operation Period, the Concessionaire shall operate and maintain the Bus Terminal in accordance with this Agreement either by itself, or through the O&M Contractor and if required, modify, repair or otherwise make improvements to the Bus Terminal to comply with the provisions of this Agreement, Applicable Laws and Applicable Permits, and conform to Specifications and Standards and Good Industry Practice. The obligations of the Concessionaire hereunder shall include: (a) permitting safe, smooth and uninterrupted flow of traffic on the Bus Terminal during normal operating conditions. Buses of other state road transport corporations shall be parked inside the Bus Terminal for which no charges shall be payable to the Concessionaire and if any charges are applicable for such parking then it shall be realized by Authority only; (b) minimising incidents affecting the safety and use of the Bus Terminal by providing a rapid and effective response and maintaining liaison with emergency services of the State; (c) carrying out periodic preventive maintenance of the Bus Terminal; (d) undertaking routine maintenance including prompt repairs of ticket counters, Workshops, Authority's Office and other infrastructure as mentioned in the Operation and Maintenance Schedule; (e) undertaking major maintenance such as per the Maintenance Schedule of the major infrastructure in the Bus Terminal; (f) preventing, with the assistance of the concerned law enforcement agencies, any encroachments on the Bus Terminal; (g) protection of the environment and provision of equipment and materials therefor; (h) operation and maintenance of all communication, control and administrative systems necessary for the efficient operation of the Bus Terminal; (i) maintaining a public relations unit to interface with and attend to suggestions from the Users, passengers, government agencies, media and other agencies; (j) complying with Safety Requirements in accordance with Article 18; (k) operation and maintenance of all Project Assets diligently and efficiently and in accordance with Good Industry Practice; (l) maintaining punctuality and reliability in operating the Bus Terminal; and (m) maintaining a high standard of cleanliness and hygiene in the Bus Terminal. 17.1.2 The Concessionaire shall remove promptly from the Bus Terminal all surplus construction machinery and materials, waste materials (including hazardous materials and waste water), rubbish and other debris (including, without limitation, accident debris) and keep the Bus Terminal in a clean, tidy and orderly condition,
