Management Right. The right of the Member to participate in the management of the Company, to vote on any matter, and to grant or to withhold consent or approval of actions of the Company.
Management Right. It is understood and agreed that the District retains all of its powers and authority to direct and control to the full extent of the law. Included in, but not limited to those duties and powers are the right to: direct the work of its employees, determine the method, means and services to be provided, establish the educational philosophy and the District's goals and objectives; insure the rights and educational opportunities of students, determine the staffing patterns; determine the number and kinds of personnel required, determine the classification of positions; maintain the efficiency of the District operation; determine the curriculum; build, move or modify the facilities; develop a budget; develop and implement budget procedures; determine the methods of raising revenue; and contract out work. In addition, the Board retains the right to hire, assign, evaluate, promote, terminate, and to take action on any emergency matter. The exercise of the foregoing powers, rights, authority, duties and responsibilities by the District, the adoption of policies, rules and regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith, shall be limited only by the specific and express terms of this Agreement, subject to the right of the Association to consult on (1) defining specific educational objectives, (2) determining content of courses and curriculum, and (3) the selection of textbooks, and then only to the extent such specific and express terms are in conformance with the laws of the State of California.

Management Right. 4.01 The Union recognizes and acknowledges that it is the right of the Company to operate and manage its business subject to the terms and provisions of this agreement, and in doing so will not act in an arbitrary or bad faith manner.

Management Right. A. The employer has the final responsibility for the direction and control of all aspects of the affairs of the school district and except as otherwise expressly provided in this agreement, the employer hereby retains and reserves unto itself all powers, rights, authority, duties and responsibilities conferred upon it by the laws and Constitution of the State of Michigan or of the United States of America and all rights and powers to manage, utilize and direct the activities of its employees.

Management Right. Except as otherwise expressly provided in this Agreement, the City retains the right to manage the Department, both directly and as delegated to the Police Chief, including but not limited to the right to: (a) Determine the mission of the City and the Department; (b) Direct the working forces; (c) Hire, classify, assign, promote, and transfer employees; (d) Suspend, demote, discipline, and discharge employees for just cause; (e) Relieve employees from duty because of lack of work or other legitimate reasons; (f) Change existing methods, operations, facilities, equipment and type or number of personnel; (g) Promulgate, make, change, and/or revoke reasonable personnel rules, regulations, policies, and work and safety rules, consistent with this Agreement and applicable law, after discussion with the Lodge as provided herein; (h) Assign work to bargaining unit and/or civilian support personnel; (i) Maintain and/or take steps to enhance the efficiency of the operation of the Department; and (j) Take whatever actions may be reasonably necessary to carry out the mission of the City and the Department.
