MEAL BREAK AND REST PERIOD. 26.1 Meal breaks will be for a period of not less than 30 minutes and not more than 1 hour, subject to agreement between the Employer and Employee. 26.2 An Employee will not be required to continuously work more than 5 hours without a meal break. 26.3 The meal break will be taken at an agreed time within the 5 hours at a time convenient to the business and the service of customers. 26.4 The Employer will use its best endeavours to ensure meal breaks are not granted within the hour immediately: after commencing work; or before ceasing work. 26.5 Meal breaks are unpaid breaks and not included in the ordinary hours of work. 26.6 An Employee will be entitled to the following rest period: 4 or more hours 1 rest period of 10 minutes to be taken at a mutually agreeable time during the period of work (not within the hour immediately prior to commencing or before ceasing work). 26.7 The rest period must be counted as time worked.
