Meter Failure. Should the metering equipment at any time fail to register proper amounts or should the registration thereof be so erratic as to be meaningless, the capacity and energy delivered shall be determined by the Cooperative from the best information available.
Meter Failure. If at any time any Metering Equipment ceases to function or is found to be outside the prescribed limits of accuracy referred to in paragraph 7.3.1 of Schedule 21 for whatever reason then, except in the circumstances referred to in Clause 60.10.2:-
Meter Failure. If the Meter fails to register for a period of fourteen (14) or fewer days , the amount of wastewater furnished during such a period shall be deemed to be the amount of wastewater delivered in the corresponding period immediately prior to the failure. If the Meter fails to register for a period greater than 14 calendar days, the amount of wastewater furnished after the initial 14-day period shall be billed an amount for a volume equal to the rated capacity of the wastewater pump(s), multiplied by the total time pumped. If the replacement of the meter is deemed necessary by Sanford, Pittsboro shall replace the Meter at its expense.
Meter Failure. Should the recording meter installed pursuant to Section 11.1 hereof fail to register during any period of time, the NET ELECTRIC OUTPUT purchased by PECO ENERGY during such period shall be estimated by PECO ENERGY . SELLER shall cooperate in making such estimates by providing to PECO ENERGY , upon PECO ENERGY 's request, registration data from any recording meter maintained by SELLER at the PROJECT SITE or other relevant data.
Meter Failure. If any meter listed in’Exhibit A fails to register, or if any meter registers an error greater than prescribed in Section- 6(b), the Party owning such inaccurate meter shall use commercially responsible efforts to immediately repair or replace it.
Meter Failure. In the case of the failure of any measurement meter of a Plant with multiple Gas suppliers, the residue stream attributable to Equity Gas production shall be determined and allotted to Producers according to the provisions of either the applicable agreement controlling the construction and operation of the Plant involved or according to related agreements executed between the owners of the Plant and the owners of any Upstream Pipeline.

Meter Failure. Should any Metering Equipment fail to register during any period of time, the amount of Thermal Energy or electricity delivered or consumed, as the case may be during such period, will be estimated based on the amounts previously delivered or consumed, as the case may be, during similar periods under substantial similar conditions, unless meter readings are available from other meters at the Site.

  • Power Failure Power Failure means the failure of power or other utility service if the failure takes place off the "residence premises". But if the failure results in a loss, from a Peril Insured Against on the "residence premises", we will pay for the loss caused by that peril.

  • Epidemic Failure Warranty Supplier warrants all Products against Epidemic Failure for a period of three years after DXC’s Acceptance. Epidemic Failure means the occurrence of the same failure, defect, or non-conformity with an Order in 2% or more of Products within any three-month period.

  • Lenders’ Failure to Perform All Advances (other than Swing Loans and Agent Advances) shall be made by the Lenders contemporaneously and in accordance with their Pro Rata Shares. It is understood that (i) no Lender shall be responsible for any failure by any other Lender to perform its obligation to make any Advance (or other extension of credit) hereunder, nor shall any Commitment of any Lender be increased or decreased as a result of any failure by any other Lender to perform its obligations hereunder, and (ii) no failure by any Lender to perform its obligations hereunder shall excuse any other Lender from its obligations hereunder.

  • Equipment Failures In the event of equipment failures beyond the Administrator's control, the Administrator shall take reasonable and prompt steps to minimize service interruptions but shall have no liability with respect thereto. The Administrator shall develop and maintain a plan for recovery from equipment failures which may include contractual arrangements with appropriate parties making reasonable provision for emergency use of electronic data processing equipment to the extent appropriate equipment is available.

  • Payment Failure Any Credit Party (i) fails to pay any principal when due under this Agreement or (ii) fails to pay, within three Business Days of when due, any other amount due under this Agreement or any other Credit Document, including payments of interest, fees, reimbursements, and indemnifications;
