Modifications and Derivative Works. You may modify the software, and use it to create derivative works, for your internal use at the site covered by this license. You may not distribute such modified or derivative software to others outside of your site without written permission. You may distribute the modifications themselves (e.g. as "patches") under terms of your choice. We encourage users to contribute modifications back into Amber, but you are under no obligation to do so.

Modifications and Derivative Works. You may not modify or create derivative works of the Software, but computer code written to current application programming interfaces for the Software that are published by EOP or otherwise disclosed by EOP to you or a third party and which are not marked "preview" or "beta" (or some similar designation) will not be considered modifications or derivative works for purposes of this restriction.

These Other NFT Media Derivatives may be similar or identical to Your NFT Media Derivatives. Accordingly, on behalf of yourself and your heirs, successors and assigns, you irrevocably covenant and agree not to assert or bring any suit, claim, demand or challenge against (a) Creator or its past, present and future parents, affiliates or licensees (or any of their partners, members, employees, officers, directors, contractors, agents and equityholders) in connection with their use, distribution, reproduction, display, perform, modification, and creation of derivative works of any NFT Media or any of their own Other NFT Media Derivatives or (b) any other Project NFT owner or its past, present and future parents, affiliates or licensees (or any of their partners, members, employees, officers, directors, contractors, agents and equityholders) in connection with the use, distribution, reproduction, display, perform, modification, and creation of derivative works of the Other Project NFT Media or any of their Other NFT Media Derivatives. The foregoing is the case even if such Other NFT Media or Other NFT Media Derivatives is similar to or the same as any of Your NFT Media Derivatives that have been created by you.

Modifications and Derivative Works. III.1. We allow you to create modifications and derivative works of your XOPlanets NFT Art under the scope of the licenses granted above. However, you acknowledge and agree that Nola Labs may also modify, create derivative works of, and update any XOPlanets NFT Art and may create works of authorship similar or identical to your own adaptations, derivative works, and modifications of any XOPlanets NFT Art. III.2. Accordingly, on behalf of yourself and your heirs, successors, and assigns, you irrevocably covenant and agree not to assert or bring any suit, claim, demand, or challenge against Nola Labs or their licensees in connection with their use of any XOplanets NFT Art or any adaptations, derivative works, and modifications thereto, even if such artwork or content is similar to or the same as any adaptations, derivative works, or modifications in any XOplanets NFT Art that have been created by you. III.3. Nothing in this License will be interpreted to grant you any rights to any XOplanets Trademarks or other industrial property rights belonging to Nola Labs. Without our written permission, you may not use any XOplanets Trademarks for any Commercial Use, including to register any domain names or social media accounts using any XOplanets Trademarks. This includes any XOplanets Trademarks that may be displayed or contained in any XOplanets NFT Art for your XOplanets NFT (and you will need to modify the XOplanets NFT Art to remove or obfuscate such XOplanets Trademarks before making any Commercial Use of such XOplanets NFT Art). III.4. You shall not remove, delete, or obscure any trademark notice, copyright notice or other intellectual property notice in any XOplanets NFT or XOplanets NFT Art. III.5. You may not use the XOplanets NFT Art in any way that constitutes unlawful, defamatory, harassing, abusive, fraudulent, racist, hateful, vulgar, cruel, illegal, or obscene activity, or that promotes any such activity.

Modifications and Derivative Works. Subject to Overland’s rights under this Agreement, S3D shall retain and own all modifications, enhancements, improvements and derivative works of the Licensed Technology developed by or for S3D or Overland after the Effective Date, including all Intellectual Property Rights therein. Nothing in this Agreement grants or will be construed to grant any license to S3D under any of Overland’s Intellectual Property Rights, by implication, estoppel or otherwise.

However, you acknowledge and agree that the Creator, as well as future Creators of the NFT, may also create their own derivative works of the NFT Content. These derivative works may be similar or identical to Your NFT Content Derivatives. Consequently, you agree not to assert any claims against the Creator or other NFT Creators for their use, distribution, reproduction, display, modification, or creation of derivative works based on the NFT Content, whether similar to Your NFT Content Derivatives or not.
