Common use of Necessary Transfers Clause in Contracts

Necessary Transfers. 1. Teachers will not be involuntarily transferred from one position to another without first having an opportunity for a conference with the Superintendent of schools, and being notified, in writing, at the earliest possible time before the effective date of transfer. 2. A teacher transferred because a position is closed may file a written request to return to that position if it is reopened. 3. When involuntary transfers are made, teachers affected shall receive notice of open positions. Such teachers may submit a written request listing, in order of preference, those open positions to which they feel they possess the necessary certification/licensure and qualifications and to which they would like to be transferred. 4. A teacher subject to involuntary transfer shall be placed in another teaching position. 5. The final decision on teacher assignments rests with the Superintendent of schools.
