Notice of Modification. Borrower shall use its best efforts to provide advance written notice to Lender of any modification to any existing Eligible Note Receivable, including, without limitation, any participations therein. Notwithstanding Borrower’s best efforts, in the event Borrower is unable to provide advance written notice to Lender of any modification to any existing Eligible Note Receivable, including, without limitation, any participations therein, Borrower shall provide prompt written notice thereof to Lender.
