NPS. (a) Members. Each User of a Participating Member will be required to register as a representative of such Member with UHC, VHA or HPPI, as applicable, prior to using NPS. UHC, VHA or HPPI, as applicable, will request such information as each deems necessary to verify that such User is an authorized representative of such Member. Each of UHC, VHA or HPPI, as applicable, shall have the right to determine whether a User has authority to access NPS.
NPS. All corporate action on the part of NPS, its officers, directors and stockholders necessary for the authorization, execution and delivery of this Agreement, the performance of all obligations of NPS hereunder and thereunder, and this Agreement constitute valid and legally binding obligations of NPS, enforceable in accordance with their respective terms, except (i) as limited by applicable bankruptcy, insolvency, reorganization, moratorium, and other laws of general application affecting enforcement of creditors' rights generally, (ii) as limited by laws relating to the availability of specific performance, injunctive relief, or other equitable remedies, and (iii) to the extent the indemnification provisions contained herein may be limited by applicable federal or state securities laws.
NPS. 2. If human remains are discovered during the project activities at the ▇▇▇▇▇▇ Site, work in the location of the discovery and immediate vicinity must stop instantly, the area must be secured, and notification provided to the following in the most expeditious manner possible according to RCW 68.50:
a. Concerned Tribes’ cultural resources staff and cultural committees, b. STATE AGENCY,
NPS. The proposed trail improvements are in close proximity to NPS property along the north and south sides of Piney Branch Road NW at Eastern Avenue NW. RK&K will submit plans to NPS for comment and prepare responses to comments. Coordination with the National Park Service on the NEPA Reevaluation will be required, which can be covered at the Stakeholder meetings as well.

New unintended consequence that canteen spend on unhealthy items (carbonated drinks, confectionary) likely to increase, likely to lead to weight gain. Ongoing risk of use of illicit substances, e.g. NPS, is increased. New unintended consequence that tobacco, lighters, associated smoking requisites may become highly valuable contraband (though less common than they currently are). New unintended consequence of potential increase in canteen spend on unhealthy items (carbonated drinks, confectionary), likely to lead to weight gain. Ongoing risk of use of illicit substances, e.g. NPS, is increased. New unintended consequence of potential for those in custody to attempt to smoke inappropriate alternative substances (e.g. tea leaves, nicotine patches) using dangerous ignition practices. New unintended consequence of pressure on staff and visitors to traffic tobacco into prison.
NPS. NPS is a corporation duly organized, validly existing and in good standing under the laws of the State of New York and has all requisite corporate power and authority to carry on its business as now conducted and as proposed to be conducted. NPS is duly qualified to transact business and is in good standing in each jurisdiction in which the failure to so qualify would have a material adverse effect on its business or properties.
