Operating Assistance. Franchisor reserves the right to require Lyric and each Franchisee to maintain standards of quality, appearance and service at all their Facilities, thereby maintaining the public image and reputation of the IHS Systems and the demand for the services and products provided thereunder, and to that end Franchisor shall provide Lyric and each Franchisee with the following ongoing assistance: (a) advertising and marketing assistance including consultation, access to media buying programs and access to broadcast and other advertising pieces and materials produced by Franchisor from time to time; (b) risk management services, including risk financing planning, loss control and claims management; (c) outcomes monitoring; and (d) consultation by telephone or at Franchisor's offices with respect to matters relating to their business in which Franchisor has expertise, including matters relating to reimbursement, government relations, clinical strategies, regulatory matters, strategic planning and business development.
Operating Assistance. The Franchisor will make available the following services during the term of this Agreement: a. Upon the reasonable request of the Marketer, consultation by telephone regarding advice related to franchise sales, Franchisee support and assistance; and b. Access to franchise sales advertising and promotional materials as may be developed by the Franchisor, which reasonable cost may be passed on to the Marketer at the Franchisor's option.
Operating Assistance. COMPANY shall furnish to FRANCHISEE such guidance and assistance in connection with the operation of the STORE as is from time to time deemed appropriate by COMPANY. Operating assistance may consist of advice and guidance with respect to (1) the standards, methods and operating procedures utilized by TREATS Stores; (2) the preparation, packaging and service of food, beverage and other products and services authorized for sale by TREATS Stores; (3) the selection, purchase and preparation of food and beverage products, and the purchase of other approved products, fixtures, equipment, signs, materials and supplies; (4) the formulation and implementation of advertising and promotional programs; and (5) the establishment and operation of administrative, bookkeeping, accounting, inventory control, sales and general operating procedures for the proper operation of a TREATS Store. Such guidance shall be furnished in the form of COMPANY's Operating Manual (as defined in Paragraph C of this Section 4), bulletins or other written materials, consultations by telephone or consultations at the offices of COMPANY or at the STORE in conjunction with an inspection of the STORE. If requested by FRANCHISEE, COMPANY shall furnish additional guidance and assistance relative to the operation of the STORE or negotiating the Lease at COMPANY's per diem fees and charges established from time to time.
Operating Assistance. The COMPANY may advise FRANCHISEE of operating problems of the Restaurant disclosed by reports submitted to or inspections made by the COMPANY. Further, the COMPANY may provide to FRANCHISEE such guidance and assistance in connection with the operation of the Restaurant as is deemed appropriate by the COMPANY. Such guidance and assistance as the COMPANY does provide may be provided, in the sole discretion of the COMPANY, in the form of bulletins and other written materials, telephone consultations, and consultations at the offices of the COMPANY or at the Restaurant in conjunction with inspections of the Restaurant. Additional guidance and assistance may be made available to FRANCHISEE, at the written request of FRANCHISEE and in the sole discretion of the COMPANY, at per then fees and charges established by the COMPANY.
Operating Assistance. FRANCHISOR will advise FRANCHISEE from time to time of operating problems of the STORE disclosed by reports submitted to or inspections made by FRANCHISOR. Further, FRANCHISOR will furnish to FRANCHISEE such assistance in connection with the operation of the STORE as is from time to time deemed appropriate by FRANCHISOR. Operating assistance may consist of advice and guidance with respect to: (1) methods and operating procedures utilized by a GJC STORE or the STORE; (2) additional products and services authorized for a GJC STORE; (3) purchasing of PRODUCTS and supplies; (4) formulating and implementing advertising, merchandising and promotional programs; and (5) the establishment of administrative, bookkeeping, accounting, inventory control, sales training and general operating procedures for the proper operation of a GJC STORE. FRANCHISEE understands and agrees that all advice and guidance provided by FRANCHISOR is only supportive of the operation of the STORE and that the overall success of the STORE is primarily dependent upon FRANCHISEE’s business abilities and efforts. FRANCHISOR will not charge FRANCHISEE for such operating assistance unless such operating assistance is made necessary by FRANCHISEE’s failure to comply with this Agreement or if FRANCHISEE requests operating assistance in excess of what is normally provided by FRANCHISOR. Any such charges will be reasonable and payable upon FRANCHISEE’s receipt of an invoice for the same.

Operating Assistance. The COMPANY shall advise MARRIOTT from time to time of operating problems of the STORES disclosed by reports submitted to or inspections made by the COMPANY. Further, the COMPANY shall furnish to MARRIOTT such guidance and assistance in connection with the operation of the STORES as is from time to time deemed appropriate by the COMPANY. Operating assistance may consist of advice and guidance with respect to: (1) methods and operating procedures utilized by "TCBY" stores; (2) additional food and beverage products and services authorized for sale by "TCBY" stores; (3) selection, purchasing and preparation of food products, beverages and other approved products, materials and supplies; and (4) formulating and implementing advertising and promotional programs. Such guidance shall, in the sole discretion of the COMPANY, be furnished in the form of the COMPANY's Operating Manual (as defined below), bulletins or other written materials, telephonic consultations and/or consultations at the offices of the COMPANY or at any STORE in conjunction with an inspection of any STORE. Additional guidance and assistance may, at the sole discretion of the COMPANY, be available at per diem fees and charges established from time to time by the COMPANY.
Operating Assistance. As provided at 23 U.S.C. 151(f)(6)(C), if included within the scope of the award, the Recipient may use grant funds for operating assistance (as defined at 23 U.S.C. 151(f)(6)(C)(ii)) for any charging and fueling infrastructure that has been acquired and installed with funds awarded under 23 U.S.C. 151(f). Eligibility for any such operating assistance is limited to a period of 5 years after the date of installation, and the amounts allowed for such assistance may not exceed the amount of the contract for the acquisition and installation of the charging and fueling infrastructure.
