Order of Layoff and Bumping. Layoffs are identified by position within a classification by the Employer. A. If layoff/reduction in force vacates a classification which consists of only one (1) position filled by one (1) employee, that employee will be affected by layoff as provided in this Article. B. In all other cases, those employees least senior and least qualified occupying position(s) to be eliminated shall be designated as affected by layoff.
Order of Layoff and Bumping. The order of layoff of unit member(s) shall be determined by seniority within 26 the affected classification. Seniority is determined by date of hire in a classification, 27 including time employed in a higher classification, if applicable. The unit member 28 with the least seniority in the affected classification shall be laid off first. Bargaining 29 unit members who are subject to layoff shall have the right to exercise bumping 30 rights into a classification previously held by the unit member, providing that the 31 classification into which he/she is bumping is equal to or lower than the classification 32 currently held.
Order of Layoff and Bumping. The order of layoff and bumping shall be as provided by 65 ILCS 5/10-2.1-18.
Order of Layoff and Bumping a) Whenever a unit member is laid off, the order of lay off within the class shall be determined by length of service. The unit member with the least seniority in the affected classification, plus seniority in an equal or higher classification shall be laid off first. b) A permanent unit member who is laid off from a class and who has previous service as a permanent unit member in an equal or lower class shall have the right to bump an employee with less seniority in that class. Seniority shall include the total length of service in the equal or lower class plus length of service in the class from which layoff occurs and in higher class. c) A unit member whose position is eliminated or whose hours are reduced or who is bumped from his/her present position, may bump a lesser length of service unit member in a position of equal or less hours (i.e. work year/work hours) within his/her classification. If no such position is available, the unit member may bump into a position of in an equal or lower classification in which the unit member previously gained permanent status provided his/her seniority is greater than the least senior unit member in that equal or lower class. d) A permanent unit member may NOT utilize total length of service in equal or higher classes for the purpose of bumping where: 1) The unit member is present in the classification subject to bumping as a result of a voluntary demotion; AND 2) The unit member does not have previous permanent status in the classification subject to bumping; AND 3) The unit member is bumped by a unit member exercising rights under 3. i. If bumped, the unit member may then bump into a previously held higher classification in which they have permanent status. ii. Seniority earned in a lower classification is not included when calculating total seniority in the higher classification. e) A unit member displaced from his/her classification as a result of being bumped shall have the same bumping rights as set forth in 3.22.2.2.b) above.

  • Order of Layoff Employees shall be laid off in order of seniority pursuant to Government Code Sections 19997.2 through 19997.7 and applicable State Personnel Board and Department of Personnel Administration rules.

  • Bumping Employees who are reduced may bump within their classification or to a lower ranking classification within their classification group where they meet the qualifications as determined by the job description, and have demonstrated ability, capacity or skill. Bumping must be within the affected employee’s current division (Article 9(B)(5) above) or to a lower division. No employee has the right to bump into a higher division. a. An employee given an initial notice of layoff can either accept the layoff or he/she can exercise seniority bumping rights. A request to bump must be made within three (3) business days of receipt of the layoff notice. The bumping right can be exercised to assume the position of the least senior employee who holds a position in the affected employee’s classification. If there is no less senior employee within the affected employee’s classification, he/she may bump the least senior employee in the immediately lower classification (and each lower classification in turn) in the same classification group, provided he/she has greater seniority and the requisite skills and qualifications to do the job. For example, if a Maintenance III position were reduced, the displaced employee could bump into a Maintenance II, Maintenance I or Courier position held by a less senior employee. Classification groups are set forth in Appendix B. b. An employee who is displaced as a result of being bumped under this Article may also use his or her seniority in the same manner to bump the least senior employee in the next lower classification within the classification group provided he/she has the skills and qualifications to do the job. c. Employees who are to be laid off may not bump employees with less seniority in higher ranking classifications within the classification group; or in higher divisions; or in positions outside their classification group. d. In order to bump, the employee must have the ability, capacity and skill to perform the job and must demonstrate the ability to perform all job functions within twenty (20) working days from the date he or she assumes the job duties. If, after twenty (20) working days, the employee cannot perform the duties of the lower ranked job in a satisfactory manner, the employee may, at the discretion of the District, either be given additional time for training and job mastery or be laid off. If he or she is laid off, the District will fill the job either by recall of an employee who was laid off from a higher ranked position within the classification group or by recalling the employee who was bumped out of that position. In the event there are no qualified individuals on the recall list, the District may fill the position using its established hiring practices. e. The employee who bumps into a lower ranked classification shall be paid according to the salary schedule for that classification and will be placed at the same incremental step held in his or her previous classification.

  • Crane Erection & Jumping (a) Cranes and man/material hoists may be erected, altered, climbed and dismantled during times when ordinary production works are in progress subject to the work being done in full compliance with a relevant operational safety zone (OSZ) plan which has been developed specifically for that operation with consideration to overall site safety. (b) The crane crew for each tower crane (Crane Crew) must consist of the following: (i) crane driver; and (ii) three (3) dogmen. (c) In addition to the appropriate tickets held by the crane driver and the dogmen, the following high risk licences must be held amongst the Crane Crew: (i) rigging; and (ii) material handling. (d) Where a Project consists of a single Crane Crew, the Employer should endeavour to ensure another member of the Crane Crew holds a crane driver licence.

  • Normal order of application Except as any Finance Document may otherwise provide, any sums which are received or recovered by any Creditor Party under or by virtue of any Finance Document shall be applied: (a) FIRST: in or towards satisfaction of any amounts then due and payable under the Finance Documents and the Master Agreement in the following order and proportions: (i) first, in or towards satisfaction pro rata of all amounts then due and payable to the Creditor Parties under the Finance Documents other than those amounts referred to at paragraphs (ii) and (iii) (including, but without limitation, all amounts payable by the Borrower under Clauses 20, 21 and 22 of this Agreement or by the Borrower or any Security Party under any corresponding or similar provision in any other Finance Document or in the Master Agreement); (ii) secondly, in or towards satisfaction pro rata of any and all amounts of interest or default interest payable to the Creditor Parties under the Finance Documents and the Master Agreement (and, for this purpose, the expression “interest” shall include any net amount which the Borrower shall have become liable to pay or deliver under section 2(e) (Obligations) of the Master Agreement but shall have failed to pay or deliver to the relevant Swap Bank at the time of application or distribution under this Clause 17); and (iii) thirdly, in or towards satisfaction pro rata of the Loan and the Swap Exposure of the Swap Bank (in the case of the latter, calculated as at the actual Early Termination Date applying to each particular Designated Transaction, or if no such Early Termination Date shall have occurred, calculated as if an Early Termination Date occurred on the date of application or distribution hereunder); (b) SECONDLY: in retention of an amount equal to any amount not then due and payable under any Finance Document or the Master Agreement but which the Agent, by notice to the Borrower, the Security Parties and the other Creditor Parties, states in its opinion will or may become due and payable in the future and, upon those amounts becoming due and payable, in or towards satisfaction of them in accordance with the provisions of Clause 17.1(a); and

  • Layoff in Lieu of Bumping An employee who elects a layoff in lieu of bumping maintains his/her reemployment rights under this Agreement.
