The Overload Limits clause sets maximum thresholds for the amount or intensity of usage, service, or capacity that a party is permitted to demand or utilize under an agreement. Summer Inter-Session teaching loads shall in no case exceed ten (10) CTLCs without prior written approval from the Vice President of Instructional Services. 5. For the regular academic year, overload warrants shall be submitted to the Riverside County Office by the end of the seventh (7) week of the spring semester, after a calculation process that should be started around February 15th. Where class enrollments are not completed in time to meet this section, a corrected warrant will be issued with the last pay warrant for the semester period.
Overload Limits. No faculty member shall carry more than one unit of overload beyond the 7th unit in a given year. The ▇▇▇▇ may authorize an additional overload unit beyond the 7th unit where there is a clear and compelling need. The additional unit assignment shall be granted upon the written approval of the ▇▇▇▇. The additional overload unit will be granted only with clear evidence of faculty involvement in advising, mentoring and course/curriculum enhancement, and with a clear and compelling curricular need. Overload Limits. 3.5.1 Classroom faculty may not teach beyond their regular full-time assignments more than six (6) LHE, except by mutual agreement between the faculty member and the supervising college administrator. 3.5.2 Faculty shall not teach beyond their regular full-time assignment for the purpose of extra pay (overload) until their regular assignment has been fulfilled. 3.5.3 Faculty may not be assigned to extra pay academic assignments without prior approval from their immediate supervising college administrator and academic ▇▇▇▇ having jurisdiction over the assigned academic course(s). 3.5.4 Non-classroom faculty may not work for more than 40% beyond their full-time assignment, except by mutual agreement between the faculty member and the supervising college administrator.

  • Overload A regular employee who works an overload in a given year shall receive no less than either: (a) the pro-rata salary for the overload based on the Provincial Salary Scale or the secondary scale on which the employee is placed or (b) a reduction of workload in a subsequent year that is commensurate with the amount of the overload. The conditions governing overloads are as set out in the regular employee’s local collective agreement, subject to the above provision.

  • Standard of Care; Uncontrollable Events; Limitation of Liability SMC shall use reasonable professional diligence to ensure the accuracy of all services performed under this Agreement, but shall not be liable to the Company for any action taken or omitted by SMC in the absence of bad faith, willful misfeasance, negligence or reckless disregard by it of its obligations and duties. The duties of SMC shall be confined to those expressly set forth herein, and no implied duties are assumed by or may be asserted against SMC hereunder. SMC shall maintain adequate and reliable computer and other equipment necessary or appropriate to carry out its obligations under this Agreement. Upon the Company's reasonable request, SMC shall provide supplemental information concerning the aspects of its disaster recovery and business continuity plan that are relevant to the services provided hereunder. Notwithstanding the foregoing or any other provision of this Agreement, SMC assumes no responsibility hereunder, and shall not be liable for, any damage, loss of data, delay or any other loss whatsoever caused by events beyond its reasonable control. Events beyond SMC's reasonable control include, without limitation, force majeure events. Force majeure events include natural disasters, actions or decrees of governmental bodies, and communication lines failures that are not the fault of either party. In the event of force majeure, computer or other equipment failures or other events beyond its reasonable control, SMC shall follow applicable procedures in its disaster recovery and business continuity plan and use all commercially reasonable efforts to minimize any service interruption. SMC shall provide the Company, at such times as the Company may reasonably require, copies of reports rendered by independent public accountants on the internal controls and procedures of SMC relating to the services provided by SMC under this Agreement. Notwithstanding anything in this Agreement to the contrary, in no event shall SMC, its affiliates or any of its or their directors, officers, employees, agents or subcontractors be liable for exemplary, punitive, special, incidental, indirect or consequential damages, or lost profits, each of which is hereby excluded by agreement of the parties regardless of whether such damages were foreseeable or whether either party or any entity has been advised of the possibility of such damages.

  • Noise The Hirer shall ensure that the minimum of noise is made on arrival and departure, particularly late at night and early in the morning. The Hirer shall, if using sound amplification equipment, make use of any noise limitation device provided at the premises and comply with any other licensing condition for the premises.

  • Ceilings 13.1 Lambdaboard ceilings, minimum 25mm thick with a width of 1220mm x 1800mm, skimmed with Plascon EZ Joint and EZ Skim system. 13.2 Cornices to be Nucornice polystyrene core cove cornice as per Everite or similar approved. ▇▇▇▇ Shadow line cornices will be at extra cost if required.

  • Usage Limits Services and Content are subject to usage limits, including, for example, the quantities specified in Order Forms and Documentation. Unless otherwise specified, (a) a quantity in an Order Form refers to Users, and the Service or Content may not be accessed by more than that number of Users, (b) a User’s password may not be shared with any other individual, and (c) except as set forth in an Order Form, a User identification may only be reassigned to a new individual replacing one who will no longer use the Service or Content. If You exceed a contractual usage limit, We may work with You to seek to reduce Your usage so that it conforms to that limit. If, notwithstanding Our efforts, You are unable or unwilling to abide by a contractual usage limit, You will execute an Order Form for additional quantities of the applicable Services or Content promptly upon Our request, and/or pay any invoice for excess usage in accordance with Section 6.2 (Invoicing and Payment).
