Overtime and Calls. 5.1 Time worked by employees on regular assignments, continuous with, before, or after the regularly assigned hours of duty shall be considered as overtime and shall be paid at one and one-half times the hourly rate of pay in minimum increments of 15 minutes. Every effort will be made to avoid the necessity for overtime; however, when conditions necessitate, employees will perform authorized overtime work as locally arranged in writing. In the absence of a local arrangement, overtime will be offered to qualified employees in seniority order, failing which the junior qualified employee will be required to work such overtime. (c) Employees called in for overtime work not continuous with completion their regular shift but working with a regular assigned shift of that employee's employees shall be required to take their meal period as normally assigned to the shift. (d) Employees called in for overtime work, but not starting at the regular tour starting time of eight hours' duty will a shift shall be allowed without deduction of pay, 20 minutes in which after two (2) hours work to eat, immediately upon completion of two hours' overtimego for a meal. 5.2 There shall be no overtime on overtime. This will not, however, prevent employees being used for other emergency work which might develop subsequent to the time called. 5.8 Employees will only be required to attend investigation outside their working hours when the requirements of the service will not permit the taking of statements during regular working hours. 5.9 Insofar as practicable helpers shall not be employed or advanced temporarily to do mechanics' work -when mechanics are available - to avoid the necessity of payment for overtime. 5.10 Employees regularly assigned to work on Saturdays and Sundays or those called to take the place of such employees, will be allowed to complete the balance of the day, unless released at their own request. Those who are called will be advised as soon as possible after vacancies become known. 5.11 Employees required to work during meal period shall receive pay at the rate of time and one-half times on the hourly rate for three hours' work or lessminute basis, but will be relieved the necessary time (without pay) to procure a meal. This does not apply to where employees whose calls are cancelled before leaving homeallowed the thirty (30) minutes for lunch without deduction therefore. 5.7 The hourly rate for weekly rated employees is computed by dividing the weekly rate by 40. 5.8 Employees required to work on their assigned rest days shall be paid at one and one-half times their hourly rate with a minimum of three hours for which three hours service may be required, except: (a) as otherwise provided under Article 6; (b) where such work is performed by an employee moving from one assignment to another or to or from part-time status in the application of seniority or as locally arranged. 5.9 Overtime lists shall be updated every second week, or as otherwise locally agreed, and posted on all bulletin boards with copy to the chairperson.

Overtime and Calls. 5.1 Time 13.1 Subject to the provisions of Article 12.4, time worked by employees on regular assignments, continuous with, before, before or after the regularly assigned hours of duty shall be considered as overtime and shall be paid at one and one-half (1 1/2) times the hourly rate of pay in minimum increments of 15 fifteen (15) minutes. (d) Such time off will be taken at a mutually agreed date, consistent with the efficient operation of the Company. All employees who have banked overtime through the year shall be updated every second weekhave their hours paid out in full on the last pay day of the year or at their written request have up to forty (40) hours of banked overtime pay deposited to an RRSP as per CRA and Company procedures. 15.9 (2011) An employee called by Royal Service between the hours of 12:00 am and 6:00 am shall receive an allowance equal to one (1) hour straight time pay for answering the call. Should the employee need to come on property at the time of the call, or as otherwise locally agreed, and posted on all bulletin boards with copy to the chairpersonminimum call in pay will apply instead.

In all other cases by regular employee. 16.11 In the assignment to another or to or from part-time status of overtime and in the application working of overtime the following rules will apply: 16.11.01 In a RTC Centre where it is necessary to fill a temporary vacancy or an extra position on an overtime basis due to no employee available to work at the straight time rate, the regular employees in that RTC Centre (including regular swing employees headquartered at that RTC Centre) shall have preference to this work on the basis of Clauses 16.11.02, 16.11.03 and 16.11.04 hereof. 16.11.02 Such overtime work shall be divided as equally as possible among those regular employees who signify in writing to the Manager RTC or his/her designate that they will be available for all such work and, as far as practicable, such employees shall be called on a rotating basis. A list of employees on each division, who have signified in writing that they are available for overtime work, will be posted once per year, and will be open for correction by any employee for a period of 30 days from the date of posting. Employees wishing to be included on the overtime list will apply, in writing, to the Manager RTC or his/her designate and an employee who no longer wishes to work overtime, may have their name removed from the list upon serving 3 days written notice. 16.11.03 The division of overtime work shall, as far as practicable, be arranged so as not to interfere with a regular employee's scheduled hours of work and so as to allow sufficient rest between tours of duty. This may be accomplished, for example, by using two employees to work 4 hours each. 16.11.04 An employee who is not available when called shall no longer participate in this arrangement unless the employee can produce satisfactory reason for the employee's non-availability. 16.11.05 In an RTC Centre where there are 2 or more Rail Traffic Controllers' positions on the same shift, and one or more such positions are cancelled on a general holiday, the work to be performed by the remaining position or positions on such holiday shift shall be divided as equally as possible among those Rail Traffic Controllers who are normally assigned to work, subject to the principles outlined in Clauses 16.11.02 and 16.11.04 above. 16.11.06 The above does not excuse an employee from working overtime when the employee is ordered by the Company to do so. 16.11.07 Employees may elect time off for overtime in lieu of payment at time and one- half. A maximum of 48 hours at the straight time rate may be accumulated at any given time for the purposes of time off and a maximum of 40 accumulated straight time hours may be taken as time off in any given instance. While the accumulation and taking time in lieu of payment at the overtime rate must be mutually agreed to between the Supervisors and employees, the final determination will be at the discretion of the Supervisors according to the requirement of the service, and may extend past being allowed 40 hours off in lieu, if staff is available. Overtime and Calls. 5.1 Time Subject to the provisions of paragraph time worked by employees on regular assignments, continuous with, before, or after the regularly assigned hours of duty shall be considered as overtime and shall be paid at one and one-half times the hourly rate of pay in minimum increments of 15 minutes. Every effort will be made to avoid the necessity for overtime; however, when conditions necessitate, employees will perform authorized overtime work as locally arranged in writing. In the absence of a local arrangement, overtime will be offered to qualified employees in seniority order, failing which the junior qualified employee will be required to work such overtime. If, however, employees are called to commence work less than two hours before regular starting time, the time will be computed continuously with the regular day's work, and the time before the regular starting time shall be paid for at the rate of time and one-half on all bulletin boards the minute basis. 8.6 Employees shall not be required to suspend work in regular working hours to equalize overtime. 8.7 All overtime earned shall be shown as a separate item on the pay cheques of employees. 8.8 A record will be kept of overtime worked and regular employees will be called with copy the purpose in view of (a) An employee is already engaged in the work for which overtime is required; (b) An employee has the qualifications required to perform the chairpersonovertime work; (c) An employee on duty is immediately available for the overtime work to be performed. 8.9 Employees required to work on regularly assigned rest days shall be paid at the rate of time and one-half.
