Common use of Overtime Compensation Clause in Contracts

Overtime Compensation. (a) Overtime worked shall be compensated at the following rates: (1) time and one-half for the first two hours of overtime on a regularly scheduled workday; (2) double-time for hours worked in excess of the two hours referred to in (1) above; and (3) double-time for all hours worked on a day of rest. The compensation of overtime in (1) and (2) is to be on a daily basis and not cumulative. (b) An employee who works on a designated holiday which is not a scheduled workday shall be considered to have worked overtime and shall receive their regular days pay, and shall receive additional compensation at the rate of double-time for all hours worked; except for Christmas and New Years when the additional compensation shall be at the rate of double-time and one-half for all hours worked. (c) An employee on travel status who is required to travel on business outside their regular working hours shall be compensated at the applicable overtime rates for all hours travelled. The Authority may determine the means of such travel. (1) Overtime shall be compensated either in cash or time off, or a combination of both at the employee's option. (2) Accumulated overtime shall be paid in cash at the fiscal year-end or on such other date(s) as provided in this agreement, or upon termination. (3) If the employee elects to take compensatory time off, the Authority shall make every reasonable effort to schedule such time off by mutual agreement within 60 days from it being earned. (4) If mutual agreement on the scheduling of compensatory time off cannot be reached within 60 days from it being earned, such unscheduled compensatory time off shall be taken in cash and the provision of (5) below shall apply. (5) Where overtime earned is paid in cash the Authority shall make every reasonable effort to make payment by the end of the month following the month in which the overtime cash payment was requested.

When an employee opts for compensatory time off, such time off shall be taken at a time mutually agreed to between the Employer and the employee. Such agreement shall not be unreasonably withheld by the Employer. Any compensatory time off remaining at the end of the calendar year shall be paid in cash. However, for compensatory time earned in November or December, it may be mutually agreed to schedule such time off within the first (1st) three (3) months of the following year. (g) Once annually, an employee who has thirty-five (35) hours of compensatory time banked as of December 1, may set aside up to thirty-five (35) hours to be taken as though it were part of their annual vacation for the following year by requesting such in writing prior to December 15.

(g) Overtime shall be compensated either calculated in cash or time off, or a combination of both at the employee's optionthirty (30) minute increments. (2) Notwithstanding (f)(1) above, an employee who has opted for compensatory time off (CTO) for overtime worked in one calendar year may, by mutual agreement, schedule the CTO to be taken by April 30th, of the following calendar year, and the employee may not subsequently opt for monetary payout for the overtime.

(c) An employee on travel status who is required to travel on employer business outside their regular working hours shall be compensated at the applicable overtime rates for all hours travelled. The Authority Employer may determine the means of such travel. (1) Overtime All overtime earned will be converted to a dollar equivalency for purposes of banking overtime. Employees wishing to be compensated for overtime shall request a dollar amount added to their paycheque pursuant to the option laid out below in 16(d)(1)(i)(ii)(iii). (i) An employee may request a payout from their overtime bank equivalent to what they would have earned for the days off work requested. Substitution rates shall be compensated either in cash or time off, or used where requested and applicable to the employee. (1d) Employees shall have the option of receiving cash for overtime compensation or the equivalent compensating time off in lieu of being paid, to a limit of fifty (50) hours. (e) If employees elect to take compensating time off for overtime compensation, they shall be entitled within sixty (60) days to schedule such earned time off. (f) At year end, or at termination of employment, any overtime banked during that calendar year shall automatically be paid in cash. (g) Overtime shall be compensated either calculated in cash or time off, or a combination of both at the employee's optionthirty (30) minute increments. (2) Accumulated overtime shall be paid in cash at the fiscal year-end or on such other date(s) as provided in this agreement, or upon termination. (3) If the employee elects to take compensatory time off, the Authority shall make every reasonable effort to schedule such time off by mutual agreement within 60 days from it being earned. (4) If mutual agreement on the scheduling of compensatory time off cannot be reached within 60 days from it being earned, such unscheduled compensatory time off shall be taken in cash and the provision of (5) below shall apply. Should this become impossible, all outstanding overtime shall be compensated by monetary payment was requestedat the end of the fiscal year, or upon termination, whichever occurs earlier. (2) Notwithstanding (f)(1) above, an employee who has opted for compensatory time off (CTO) for overtime worked in one calendar year may, by mutual agreement, schedule the CTO to be taken by April 30th, of the following calendar year, and the employee may not subsequently opt for monetary payout for the overtime.

Such agreement shall not be unreasonably withheld by the ▇▇ ▇▇▇▇▇. Any compensatory time off remaining at the end of the calendar year shall be paid in cash. However, for compensatory time earned in November or December, it may be mutually agreed to schedule such time off within the first three months of the following year. (g) Once annually, an employee who has 35 hours of compensatory time banked as of December 1st, may set aside up to 35 hours to be taken as though it were part of their annual vacation for the following year by requesting such in writing prior to December 15th.
