Overtime HVAC. Article 29F of the Lease shall be applicable with respect to the Second Additional Premises, except that the initial rate for such after-hours heat and air-conditioning service shall be the then current Building rate for such service (and not the $100 per hour referenced in said Article 29F, which initial rate shall continue to be applicable with respect to the Existing Demised Premises). Tenant acknowledges that it has been advised that the current Building rate for after-hours heat service is $410.00 per hour, and that the current Building rate for after-hours air-conditioning service is $176.00 per hour.
Overtime HVAC. Tenant’s clean room areas shall be served by a dedicated HVAC system controlled by Tenant and with energy provided under Tenant’s metered electricity. The HVAC system for the balance of the Premises shall be tied into the Building HVAC system and shall be available for use by Tenant on a 24/7/365 basis with all expenses for HVAC service and energy use included in Operating Expenses, and with no separate charge to Tenant for use outside regular Business Hours.
Overtime HVAC. To furnish heating, ventilation and cooling services both during Normal Business Hours and upon notice from Tenant as provided below, at times other than during Normal Business Hours (“Overtime HVAC Services”). For Overtime HVAC Services Tenant shall pay to Landlord the “Overtime HVAC Charge.” The “Overtime HVAC Charge” is currently $80.00 per hour per floor and is subject to increase by Landlord from time to time. Overtime HVAC Services shall be provided for a minimum of two (2) hours and Tenant shall submit a request to Landlord not less than twenty four (24) hours prior to the commencement of said Overtime HVAC Services, which request may be made via telephone or email to the Building manager.
Overtime HVAC. If heating and air conditioning is required after normal business hours, Lessee agrees to reimburse Lessor at a rate of $65.00 per hour per floor for the overtime usage. Lessee shall reimburse Lessor within thirty (30) days after request. In the event of a rate increase through the utility company, such rate per hour shall be subject to increase. Lessor shall provide thirty (30) days notice of such increase.
Overtime HVAC. In the event that Sublessee shall require overtime heating, ventilating or air conditioning, or any other service for which Landlord may impose a separate charge, Sublessee shall notify Landlord directly in accordance with the provisions of the Main Lease, and Sublessee shall reimburse Sublessor for the full amount of the charges made by Landlord for providing such services, such reimbursement to be paid on demand.
Overtime HVAC. If Tenant shall require heat or air conditioning services at any time other than those times specified in Section 20.1 hereof, Landlord shall furnish such service during such times upon advance notice from Tenant received by 2:30 p.m. of the Business Day for which overtime service is desired or by 2:30 p.m. of the Business Day prior to the non-Business Day on which such service is requested and Tenant shall pay to Landlord within thirty (30) days after Landlord's demand therefor, as Additional Rent hereunder, Landlord's reasonable charges for providing such service.
Overtime HVAC. Provided Landlord receives advance notice from Tenant not later than 2:00 p.m. on a business day (i.e., Monday through Friday, holidays excluded) during the Cooling Season for evening service on the same business day and not later than 2:00 p.m. on the preceding business day for service on a non-business day, Landlord shall make available to Tenant and Tenant shall be permitted to use either the Existing HVAC Equipment servicing the Existing Premises, 20th Floor Premises and/or 21st Floor Premises on a floor-by-floor basis during hours and days beyond Monday through Friday from 8:00 a.m. to 6:00 p.m., provided Tenant shall pay the Landlord, as Additional Rent, the sum of $80.00 per hour per floor for such usage within twenty (20) days after demand.
Overtime HVAC. The Fixed Rent does not include any charge to Tenant for the furnishing of HVAC to the Premises during any periods other than Ordinary Business Hours (“Overtime Periods”). If Tenant desires HVAC services during Overtime Periods, Tenant shall deliver notice to the Building office requesting such services by 2:00 p.m. of the Business Day on which or preceding the date such services are to be provided; provided, however, that Landlord shall use reasonable efforts to arrange such service on such shorter notice as Tenant shall provide. If Landlord furnishes HVAC service during Overtime Periods, Tenant shall pay to Landlord the cost thereof at Landlord’s then established rate for such service in the Building, presently estimated at $203 per hour.
Overtime HVAC. Landlord shall not be required to ------------- furnish any HVAC service during periods other than for the hours and days set forth in Section 11.2 hereof ("Overtime Periods") unless Tenant delivers notice to Landlord's property management office requesting such services at least twenty-four (24) hours prior to the time at which such services are to be provided, but Landlord shall use reasonable efforts (without obligation to incur any additional cost) to arrange such service on such shorter notice as Tenant shall provide. If HVAC is furnished to the Premises during Overtime Periods, then the direct utility costs incurred by Landlord thereby shall be includable within Operating Expenses, but Tenant shall not be obligated to reimburse Landlord for any increased depreciation to the HVAC System resulting thereby.
Overtime HVAC. The current rate of HVAC usage other than the normal Business Hours is $35.00 per hour, which fate is subject to change. Notwithstanding the foregoing, Landlord shall provide Tenant with up to eighty (80) hours of overtime HVAC at no additional cost during the Lease Term.
