Pay for Work on Sunday Clause Samples

The 'Pay for Work on Sunday' clause establishes the terms under which employees are compensated for performing work on Sundays. Typically, this clause specifies that employees are entitled to additional pay, such as overtime rates or a Sunday premium, for hours worked on that day. For example, it may require employers to pay time-and-a-half or double time for Sunday shifts. The core function of this clause is to incentivize employees to work on a traditionally non-working day and to ensure fair compensation for work performed outside standard work schedules.

Pay for Work on Sunday. When a workday in a full-time employee's basic workweek falls on Sunday, the employee is paid a premium of 25 percent of the straight-time rate on such Sundays that he/she actually works. Employees do not receive the premium if they are on leave. A scheduled shift is considered to be completely a Sunday shift when four or more hours fall on Sunday. If fewer than four hours fall on Sunday, no part of the shift belongs to Sunday. The premium does not apply to overtime hours on a Sunday that is either within or outside the basic workweek. If a holiday falls on Sunday, the employee receives the Sunday premium, computed on the straight-time rate, in addition to the holiday pay.
