Payment in Lieu of Long Service Leave. (a) Payment in lieu of Long Service Leave Generally
(i) A employee with 10 years' continuous service with the school may cash out an amount of accrued but untaken long service leave that exceeds the amount of long service leave that the employee would have accrued if the rate of accrual
A. the employee elects to cash out the additional long service leave;
B. the employee provides a written election to the school stating that the employee wishes to cash out the additional long service leave; and
C. the school, in its discretion, authorises the employee to cash out the additional long service leave.
(ii) If a employee cashes out an amount of additional long service leave in accordance with this clause:
A. the school will, within a reasonable time, give the employee the amount of pay they would have received if they had taken the long service leave that the employee cashed out;
Payment in Lieu of Long Service Leave. (a) An Employee with 10 years' continuous service with the Employer may cash out an amount of additional long service leave accumulated by the Employee which is in excess of their entitlements under the LSL Act (this means long service leave accrued in excess of 0.866 weeks per year).
(b) Subject to the Employee having 10 years' service, long service leave may be cashed out on the following basis:
(i) the Employee elects to cash out some or all of that portion of their accrued long service leave which is the leave accrued in excess of the 0.866 weeks per year accrued under the LSL Act;
(ii) the Employee provides a written election to the Employer stating that the Employee wishes to cash out the accrued long service leave; and
(iii) the Employer, in its discretion, authorises the Employee to cash out the accrued long service leave.
(c) If an Employee cashes out an amount of accrued long service leave in accordance with this clause:
(i) the Employer will, within a reasonable time, give the Employee the amount of pay they would have received if they had taken the long service leave that the Employee cashed out; and
(ii) the Employee will no longer be entitled to the long service leave they have cashed out.

A Teacher in the ACT with seven years' continuous service with the School may cash out an amount of additional long service leave accumulated by the Teacher which is in excess of their entitlements under the LSL Act (ACT) (this means long service leave accrued in excess of 0.866 weeks per year in accordance with clause 20.10(c). A Teacher in NSW with 10 years’ continuous service with the School may cash out an amount of additional long service leave accumulated by the Teacher which is in excess of their entitlements under the LSL Act (NSW) (this means long service leave accrued in excess of 0.866 weeks per year in accordance with clause 20.10(c). Cashing Out of Long Service Leave
(i) the Teacher elects to cash out some or all of that portion of their accrued long service leave which is the leave accrued in excess of 0.866 weeks per year;
(ii) the Teacher provides a written election to the School stating that the Teacher wishes to cash out the accrued long service leave; and
(iii) the School, in its discretion, authorises the Teacher to cash out the accrued long service leave. If a Teacher cashes out an amount of accrued long service leave in accordance with this clause 20.10:
(i) the School will, within a reasonable time, give the Teacher the amount of pay they would have received if they had taken the long service leave that the Teacher cashed out; and
(ii) the Teacher will no longer be entitled to the long service leave they have cashed out.
Payment in Lieu of Long Service Leave. (a) An Employee with 10 years' continuous service with the School may cash out an amount of accrued but untaken long service leave that exceeds the amount of long service leave that the Employee would have accrued if the rate of accrual in the LSL Act applied to the Employee's employment (the additional long service leave), on the following basis:
(i) the Employee elects to cash out the additional long service leave;
(ii) the Employee provides a written election to the School stating that the Employee wishes to cash out the additional long service leave; and
(iii) the School, in its discretion, authorises the Employee to cash out the additional long service leave.
(b) If an Employee cashes out an amount of additional long service leave in accordance with this clause:
(i) the School will, within a reasonable time, give the Employee the amount of pay they would have received if they had taken the long service leave that the Employee cashed out;
(ii) the Employee's entitlements to long service leave will be reduced by the extent of such payment and the Employee will no longer be entitled to the long service leave that they have cashed out; and
(iii) the Employee may not seek to cash out further additional long service leave accrued until the Employee has completed a further 5 years’ service from the time that the Employee last became entitled to the benefit of this clause, unless the School agrees otherwise.
(c) The parties agree that the primary purpose of long service leave is for an Employee to have an extended period of rest and recuperation away from work and that this will be taken into account in any decision to cash out additional long service leave.
Payment in Lieu of Long Service Leave. Where a Teacher has an entitlement to long service leave and takes leave in accordance with the Long Service Leave ▇▇▇ ▇▇▇▇ (NSW) (that is, at least for a month) the Teacher and the Employer may agree that, in addition to payment for the long service leave taken, the Teacher may be paid an amount in lieu of any additional long service leave accumulated by the Teacher. The portion of long service leave that may be cashed out must not include the minimum leave entitlement under the Long Service Leave ▇▇▇ ▇▇▇▇ (NSW). Any payment arising from the conditions applicable in this subclause will be paid by the Employer upon the commencement of the Teacher’s long service leave.
Payment in Lieu of Long Service Leave. Where a teacher has an entitlement to long service leave and takes leave in accordance with the NSW Long Service Leave Act (i.e. at least for a month) the teacher and the employer may agree that, in addition to payment for the long service leave to be taken, the teacher be paid an amount in lieu of any additional long service leave accumulated by the teacher. Any payment arising from the conditions applicable in this subclause will be paid by the employer upon the commencement of the teacher’s long service leave.
