Common use of Payment of Shift Differential Clause in Contracts

Payment of Shift Differential. Shift differential will not be used to calculate the hourly rate of pay for paid time off. Employees will not be paid shift differential, or have their shift differential changed, for overtime hours that abut the employees’ regular shift or are a call-in or court time. Overtime that does not abut the employee’s regular shift, e.g., voluntary or assigned overtime on the employee’s day off will include shift differential as in Sections 42.1 or 42.2 whichever is applicable.
