Performance Engineer’s Program Sample Clauses

Performance Engineer’s Program. 1.1 In addition to the standard operational Technical Data provided under Clause 14A, the Seller shall provide to the Buyer the Performance Engineer’s Programs (“PEP”) for the Aircraft type covered under this Agreement. Such PEP is composed of software components and databases and its use is subject to the licence conditions set forth in Part 1 of Exhibit I to the Agreement, “Licence for Use of Software”.

Performance Engineer’s Program. 14.13.1 In addition to the Technical Data provided under Clause 14, the Seller will provide to the Buyer Software Services, which will consist of the Performance Engineer’s Programs (“PEP”) for the Aircraft type covered under this Agreement. Such PEP is composed of software components and databases, and its use is subject to the license conditions set forth in the End-User License Agreement for Airbus Software. 14.13.2 Use of the PEP will be limited to one (1) copy to be used on the Buyer’s computers for the purpose of computing performance engineering data. The PEP is intended for use on ground only and will not be placed or installed on board the Aircraft. 14.13.3 The license to use the PEP and the revision service will be provided ***** Revision Service Period as set forth in Clause 14.5. 14.13.4 At the end of such PEP Revision Service Period, the PEP will be provided to the Buyer at the standard commercial conditions set forth in the Seller’s then current Customer Services Catalog.

Performance Engineer’s Program. The Seller will provide to the Buyer Software Services, which will consist of the Performance Engineer’s Programs (“PEP”) for the aircraft type covered under this Agreement. PEP is composed of software components and databases, and its use will be subject to the software license agreement published in the CS Catalog as in effect from time to time. The Seller, subject to appropriate confidentiality commitments, shall cooperate with the Buyer’s third party performance data providers for the disclosure of data needed for use of the PEP.

Such PEP is composed of software components and databases, and its use is subject to the license conditions as set forth in the End-User License Agreement for Airbus Software, as set forth from time to time in the CS Catalog, which End-User License Agreement for Airbus Software, as in effect from time to time, is incorporated by reference herein. 14.13.2 Use of the PEP will be limited to one (1) copy to be used on the Buyer’s computers for the purpose of computing performance engineering data. The PEP is intended for use on ground only and will not be placed or installed on board the Aircraft. 14.13.3 The license to use the PEP and the revision service will be provided […***…]. 14.13.4 At the end of such PEP Revision Service Period, the PEP will be provided to the Buyer at the standard commercial conditions set forth in the Seller’s then current Customer Services Catalog.

Performance Engineer’s Program. In addition to the standard operational manuals, the Seller will provide to the Buyer or its Operators, as the case may be, the Performance Engineer’s Programs (PEPs) under the terms and conditions of the General Conditions of Licensing For Use Of Software, attached as Appendix 1 hereto . Use of the PEP will be limited to one (1) copy installed on one (1) computer for the Buyer and for each of its Operators. PEP is intended for use on ground only and will not be installed on an Aircraft. The Seller will provide the Buyer and each of its Operators with a three-day installation and review visit regarding the PEPs. The license for use of PEP will be granted free of charge for a period equal to the Revision Service Period. At the expiration of that period, the Buyer and its Operators will be entitled to continue to use the PEP free of charge, but the Buyer or its Operators, as the case may be, will be charged for all revisions, in accordance with the terms and conditions of the then-current CSC. These proprietary rights will also apply to any translation into a language or languages or media that may have been performed or caused to be performed by the Buyer and its Operators.
