Plans and Specifications; Construction Contract Clause Samples

The "Plans and Specifications; Construction Contract" clause defines the requirement that all construction work must adhere to the detailed plans and specifications provided as part of the contract. Plans and Specifications; Construction Contract. (a) Plans and Specifications shall be prepared by a licensed architect and which Plans and Specifications shall meet with the approval thereof by any Governmental Authority then exercising jurisdiction with regard to such work and such Plans and Specifications shall be and become the sole and absolute property of Landlord in the event that, for any reason, this Lease shall be terminated. (b) The Structural Alterations contract shall be made with a licensed contractor, providing for the completion of all work, labor and materials necessary for completion of the Structural Alterations in accordance with the Plans and Specifications.
Plans and Specifications; Construction Contract. (a) Plans and Specifications shall be prepared by an architect satisfactory to Landlord and which Plans and Specifications shall meet with the approval of Landlord, together with the approval thereof by any Governmental Authority then exercising jurisdiction with regard to such work and such Plans and Specifications shall be and become the sole and absolute property of Landlord in the event that, for any reason, this Lease shall be terminated. (b) The Initial Construction contract shall be made with a contractor satisfactory to Landlord, providing for the completion of all work, labor and materials necessary for completion of the Initial Construction in accordance with the Plans and Specifications.
Plans and Specifications; Construction Contract. At or prior to closing hereunder, and prior to a request for each issuance of a Letter of Credit, Borrowers shall deliver to Bank for inspection and review, the final plans and specifications (the “Plans and Specifications”), as approved by the applicable municipality and county, including a list of all contractors engaged to work on all improvements to be made to the applicable Project, and including, without limitation, subdivision approval from the applicable municipality and county, and copies of all permits, licenses, and approvals issued in connection with the applicable Project. Notwithstanding anything contained herein to the contrary, the Bank shall have no obligation to disburse any of the proceeds of the Construction Line of Credit Sub-Loan until it approves the applicable Plans and Specifications, and receives a copy of the permits, licenses, and approvals, and including, without limitation, the applicable subdivision approval. Further, Borrowers hereby covenant and agree that they will not alter, amend, or modify the Plans and Specifications, or approve any change orders for the construction of improvements to the applicable Project, without the express, prior written consent of the Bank.

  • Plans and Specifications After Landlord receives and approves Tenant’s Space Plan as provided above, Tenant will cause Tenant’s Architect to prepare the Plans and Specifications for the Tenant Improvements. Landlord will approve or disapprove (specifically describing any reasons for disapproval) the Plans and Specifications in writing within ten (10) Business Days after receiving them. If Landlord disapproves the Plans and Specifications, Tenant will provide appropriately revised Plans and Specifications to Landlord for approval (or disapproval) within five (5) Business Days on the same basis as set forth above. After Landlord’s approval, Tenant will submit the Plans and Specifications for permits and construction bids. No deviation from the Building Standard will be permitted in the Space Plan or the Plans and Specifications, provided reasonable deviations with respect to the ceiling, lighting, painting, flooring and wall covering may be permitted with Landlord’s approval. Landlord will not approve any deviations which Landlord believes (a) do not conform to applicable codes, ordinances and other Laws or are disapproved by any governmental agency, (b) require services beyond the level normally provided to other tenants in the Building, or (c) are of a nature or quality that are inconsistent with Landlord’s overall plan or objectives for the Building. No approval by Landlord of any deviation constitutes an acknowledgment by Landlord that such deviations are in conformance with applicable codes, ordinances and other Laws. In the event that Landlord’s approval shall be required in this Tenant Improvements Agreement, then notwithstanding anything to the contrary set forth in the Lease, Landlord’s approval shall not be unreasonably withheld, conditioned, or delayed.

  • Construction Contract Documents The Construction Contract Documents shall consist of the plans and specifications prepared by the Engineer, and any addenda and change orders thereto, and the Owner-Contractor Agreement, all of which shall be compatible and consistent with this Agreement.

  • Construction Contract If federal funds are included as part of the financing of the non-OPWC portion of the Project, federal law may prevail, including, but not limited to, application of ▇▇▇▇▇ ▇▇▇▇▇ prevailing wage rates, the ▇▇▇▇▇▇▇▇ “Anti-Kickback” Act, the Contract Work Hours and Safety Standards Act, and any federal environmental regulations. Recipient is solely responsible for ensuring compliance with federal requirements applicable to its Local Subdivision Contribution. Notwithstanding the above, the following provisions apply to construction contracts under this Agreement:

  • Construction Contracts Item A: Enter the total dollar amount of all contacts awarded on the project/ program. Item B: Enter the total dollar amount of contracts connected with this project/program that were awarded to Section 3 businesses.

  • Approval of Plans and Specifications The Plans and Specifications will conform to the requirements and conditions set out by applicable law or any effective restrictive covenant, and to all governmental authorities which exercise jurisdiction over the Leased Premises or the construction thereon.
