Policy and Procedure Manuals. The College will provide each Dispatcher with copies of appropriate departmental policy and procedure manuals, including the Dispatcher Policy and Procedure Manual. Current job duties and responsibilities will be included in the Dispatcher Policy and Procedure Manual. An additional copy of all appropriate manuals shall be available in the Central Dispatch Area.
Section 39.1 In the event the College subcontracts work, the College will first give the Union thirty (30) days advance notice of an intention to subcontract bargaining unit work during which time the College and the Union will meet to negotiate with regard to the decision and its effects; however, if the College and the Union do not reach agreement during this thirty (30) day period, the College retains the sole and unrestricted right to unilaterally implement its decision to subcontract bargaining unit work; however, upon such implementation, the Union retains the right to strike pursuant to all applicable laws, the no-strike provision of this contract notwithstanding.

Until October 31, 2013, New Operators shall be permitted to use Existing Operators’ policy and procedure manuals in connection with New Operators’ operation of the Facilities. As soon as practicable after such period, and in all events within thirty (30) days thereafter, New Operators shall destroy all such policy and procedure manuals and provide Existing Operators with an affidavit to such effect, signed by a duly authorized officer of New Operators.

As of the Commencement Date, Current Operators shall also print a current copy or make available in digital form of the Facilities’ policies and procedures, which will be left at the Facilities and transferred to New Operators under the Bill of Sale and General Assignment referenced in Section 3 of this Agreement, provided, however, Current Operators shall have no liability associated with New Operators’ use of the same.
