POSTPONEMENT OF THE EVENT. In the event that the Customer wishes to postpone the Event, the Customer will advise the JSE in writing of such postponement at least 60 (sixty) days prior to the Event. The postponement of the Event will be subject to resubmission by the Customer of an amended Booking Form recording the new date and time of the Event agreed to and this shall be confirmed by the JSE in writing. If the postponed Event is subsequently cancelled by the Customer, subject to clause 6.5, the JSE reserves the right to levy an administration fee of 30 % (thirty per cent) of the Fees in relation to such cancellation.

In such event, the Event Organiser shall have the election either, to accept such later date for the holding of the Event, in which event clauses 1.4 and 1.5 above shall be deemed to have been amended accordingly; or,
POSTPONEMENT OF THE EVENT. In the event that SERVIER notifies the EVENT AGENCY of a request for postponement that is not due to Force Majeure or health or terrorist risks before the Event date, the EVENT AGENCY undertakes to find a new date for the Event in agreement with SERVIER. This date may only be set within a maximum of one (1) year following the date of notification of the request for postponement. The date of notification will be the day on which the written notification is sent. The EVENT AGENCY will present SERVIER with a new modified offer (i) of the Services (Appendix 1), and (ii) of the Budget (Appendix 2), on the basis of which the Parties undertake to negotiate in good faith. If the Parties reach an agreement, this will be embodied in an amendment to the Agreement duly signed by the Parties. If the Parties fail to reach an agreement, the Agreement will be de facto terminated.
POSTPONEMENT OF THE EVENT. If Client postpones the Event, Client will not receive any refund of any portion of the Planning Fee. All portions of the Planning Fee will be applied to future Services, so long as the postponed Event date is less than one (1) year from the initial start date of the Event.

If the Event is postponed for any reason (i) MCI must promptly notify the Exhibitor in writing, giving reasons; (ii) this Agreement (including this clause 11) applies to the postponed Event; (iii) MCI or the Host may retain monies paid by the Exhibitor up to the date of the notice of postponement; (iv) The Exhibitor must pay or provide any portion of the Exhibition Fee that is unpaid (at the time of the postponement notice) within the times adjusted to apply to the postponed Event and must otherwise comply with its obligations under this Agreement; and (v) Each party shall perform its obligations under this Agreement in connection with the postponed Event.
