Prior Occupancy. In the event the Premises are delivered to and are occured by Tenant prior to the Commencement Date of the Term of this Lease, such occupancy shall be subject to all the terms and conditions of this Lease.

Notwithstanding the above, Owner shall be responsible for loss of or damage to the Work resulting from Prior Occupancy.
Prior Occupancy. If Tenant occupies the leased Premises prior to the beginning of the term with ▇▇▇▇▇▇▇▇’s consent, all the provisions of this Lease shall be in full force commencing at such occupancy. Rent for such period shall be based on the above schedule; a prorated monthly installment shall be calculated on a thirty (30) day month.

If Tenant does take possession pursuant to authority so given, all of the covenants and conditions of the Lease shall apply to and shall control such occupancy, except for the obligation to pay the Additional Premises Base Rent. Additional Rent for such occupancy shall be paid upon occupancy and on the first of each calendar month thereafter, as determined in accordance with Paragraph 4 above. If the Additional Premises are occupied for a fractional month, the Additional Rent applicable to the Additional Premises shall be prorated on a per diem basis.
