Procedure for Use of Sick Leave Bank. Only tenured members of the Sick Leave Bank shall be allowed to withdraw days from the Bank. In order to remain an active member, a teacher must contribute to the bank when assessed by the Sick Leave Bank Committee. Once a teacher withdraws from the Bank or elects not to seek membership, he/she shall not be eligible to participate in the Sick Leave Bank. After the maximum two hundred thirty (230) days is reached, should the total number of days withdrawn from the bank equal the balance at any time, the Sick Leave Bank will cease operations until it can be replenished at the start of the next school year. Upon depletion of his/her sick leave and personal leave days, any qualified teacher may make written application to the Sick Leave Bank governing committee to utilize Sick Leave Bank days. Should the teacher be unable to make a written application, his/her designee may do so on his/her behalf. Any teacher currently enrolled in Sick Leave Bank shall be entitled to draw from the bank for his/her personal use provided the following five (5) conditions are met: a. The teacher has contributed to the Sick Leave Bank at least one day from his/her sick leave. b. The teacher has used all his/her personal accumulated sick leave days and personal days. c. The teacher shall produce a doctor’s certificate as proof of his/her need. d. The teacher has been absent more than three (3) consecutive workdays in connection with the same long term or life-threatening illness or injury. e. The teacher absence must be related to health conditions of mother and/or child and not related to family and medical leave time.
Procedure for Use of Sick Leave Bank. Any employee who is a member of the Sick Leave Bank shall be entitled to draw from the Bank provided the following conditions are met: a. The employee has used all his/her personal accumulated sick days and personal days. b. The employee shall produce a doctor’s certificate as proof of need. c. In order to access the Sick Leave Bank the employee must be absent with the same illness for more than three (3) consecutive days. No days are reimbursed from the Sick Leave Bank until the employee has used ten (10) unpaid days. After the employee has used ten (10) unpaid days, the first three days of that time will be granted as sick leave from the Sick Leave Bank. d. Any Employee who is a member of the Sick Leave Bank shall be entitled to draw from the Bank provided the following conditions are met. a. Any Employee eligible for disability benefits from Worker’s Compensation shall as a condition of withdrawing days from the Sick Leave Bank, show proof to the Sick Leave Committee that said Employee has applied for benefits from Worker’s Compensation. The Bank will supplement the difference between the net value of the disability benefits paid by Worker’s Compensation and the net value of the Employee’s salary for the number of days used, less amount withheld for income taxes.

The participant has made all of the assessed contributions to the Sick Leave Bank. b. The participant has used all their personally accumulated Sick Leave Days and Personal Days. c. The participant has produced a doctor’s certificate as proof of their need (if applicable). d. The participant has been absent (or anticipates an absence) more than three (3) consecutive workdays in connection with the same long-term condition. e. The participant’s extended absence is otherwise deemed necessary and appropriate by the Sick Leave Bank Approval Committee, provided the request falls in line within the definitions established in Article 6.1.A.

  • Level Four - Arbitration a. Within ten (10) school days after such written notice of submission to arbitration, the Board and the Association shall attempt to agree upon a mutually acceptable Arbitrator and shall obtain a commitment from said Arbitrator to serve. If the parties are unable to agree upon a mutually acceptable Arbitrator, or obtain such a commitment within the specified period, a request for a list of Arbitrators may be made to the Public Employment Relations Commission by either party. The parties shall then be bound by the rules and procedures of the Public Employment Relations Commission in selection of an Arbitrator. b. The Arbitrator so selected shall confer with the Committee of the Board and the Aggrieved Person and Association representative, and hold hearings promptly and shall issue his decision not later than twenty (20) days from the date of the close of the hearings, or if oral closings have been waived, then from the date the final statements and proofs on the issues are submitted to him. The Arbitrator's decision shall be in writing and shall set forth his findings of fact, reasoning and conclusions on the issues submitted. The Arbitrator shall be without power or authority to make any decision which requires the commission of an act prohibited by law, or which is violative of the terms of this Agreement. The decision of the Arbitrator shall be submitted to the Board and the Aggrieved Person and Association representative, and shall be final and binding on the parties. The Arbitrator shall be limited to the issues submitted and shall consider nothing else. The Arbitrator can add nothing to, nor subtract anything from the Agreement between the parties. c. The costs for the services of the Arbitrator, including per diem expenses, if any, and actual and necessary travel, subsistence expenses, and the cost of the hearing room, shall be borne equally by the Board and the Association. Any other expenses incurred shall be paid by the party incurring same.

  • Procedure for taking possession - The Promoter, upon obtaining the occupancy certificate* from the competent authority shall offer in writing the possession of the [Apartment/Plot], to the Allottee in terms of this Agreement to be taken within two months from the date of issue of occupancy certificate. [Provided that, in the absence of local law, the conveyance deed in favour of the allottee shall be carried out by the promoter within 3 months from the date of issue of occupancy certificate]. The Promoter agrees and undertakes to indemnify the Allottee in case of failure of fulfilment of any of the provisions, formalities, documentation on part of the Promoter. The Allottee, after taking possession, agree(s) to pay the maintenance charges as determined by the Promoter/association of allottees, as the case may be after the issuance of the completion certificate for the project. The promoter shall hand over the occupancy certificate of the apartment/plot, as the case may be, to the allottee at the time of conveyance of the same.
