PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. (In 2011, the Florida Legislature passed statutory changes eliminating the granting of new Professional Service Contracts and prohibiting the School Board from following the requirements outlined in Sections 14.1, 14.1-1, 14.1-2, and 14.1-3 of the contract below. These provisions are therefore placed in abeyance until all legal challenges have been resolved. All other Sections beginning with 14.2 remain in full force and effect.)
14.1 Any teacher who meets the following requirements on or before September 1 of the fiscal year shall be issued a professional service contract:
14.1-1 Holds a regular or professional certificate as defined by State Board Regulations and as prescribed by §1012.33
PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. A. The assignment of a teacher shall not include teaching any subject outside his/her areas of endorsed licensure.
B. The Association’s President shall be furnished with a copy of the master schedules for each school within four weeks of the start of the semester. The Association’s President shall also be notified of any change in the master schedules as they occur.
C. A teacher shall be given written notice of his/her tentative assignment for the forthcoming year prior to the close of the present school term. In the event a change in assignment is made, the affected teacher shall be notified promptly of the change and the reasons for such change. In no event shall changes in the teacher's assignment be made later than twenty-five (25) calendar days preceding the commencement of the next school term unless an emergency situation or significant changes in student enrollment requires same. However, if a school re-schedules, written notice of his/her tentative assignment for the forthcoming semester shall be provided no later than fifteen (15) calendar days preceding the commencement of the next school semester. This subsection C shall not apply to teacher transfers of any kind.
D. The Board of Education, the Administration, and the Faculty Association recognize the desirability of maintaining the continuity of successful co-teaching relationships, of avoiding the pairing of two inexperienced first year teachers in a co-teaching relationship, of assigning co- teaching teams to identical preparation periods, and of providing co-teachers with suitable training related to the co-teaching process. When determining co-teaching relationships, assigning preparation periods and developing training opportunities, the Board and Administration agree to consider the foregoing factors, along with applicable scheduling, staffing and financial concerns, and the number of course preparations and different co-teaching pairings,
1. Co-teachers will be notified of their assignment at least ten (10) calendar days before the start of the school year. In the event changes in such assignments are made, the affected teacher shall be notified promptly of the change and the reasons for such change.
2. Volunteer regular education teachers with appropriate certification will be considered first as part of a co-teaching pair. A list of volunteers will be established by March 1 of the preceding school year.

PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. 7.1 The Board’s goal is to hire teachers who hold certificates, permits, or vocational authorizations valid for the positions to which they are assigned; who meet the standards required by the RSC and MDE guidelines. The responsibility for being properly certificated to teach in the school district rests solely with the individual teacher. The Board will continue its present practice of informing the teachers of this prime responsibility and the manner in which it may be fulfilled. The Association shall be notified of any such action. The Board agrees that teachers employed by the Board, who hold annual authorizations, shall, as a condition of employment make every attempt to obtain permanent status through recognized work and/or study programs as per MCL 380.1233 and/or MCL 380.1233 (b).
7.2 The Board and the Association agree that affirmative steps must be taken to recruit teachers from various ethnic minority groups. Both parties agree that a highly significant part of the educational experience of children in today's society involves cross racial experiences. Part of that experience must be with ethnic minority group members who are educators. Discrimination against applicants for employment or employees of the school district on the basis of race, color, religion, national origin, age, sex, height, weight, marital status, or handicap which does not impair an individual's ability to perform adequately in a particular position or activity is prohibited.
7.3 All substitute teachers employed by the Board shall meet the requirements of the Michigan Certification Code.
PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. A. Teachers employed by the Board of Education for a regular teaching assignment as recognized in Article I, Section A of this Agreement, must have a temporary vocational authorization, occupational, provisional, continuing, professional, or permanent teaching certificate valid in the State of Michigan and meet State and Federal requirements, as applicable.
B. The scope of the teaching certificate on file with Human Resources as of March 31 of a school year shall be used to assign a teacher for the next school year, except temporarily and for good cause.
C. A copy of the final assignments will be sent to the association by the Executive Director of Human Resources Department.
D. Teachers will be given written notice of their assignments (including extra-curricular assignments, where applicable) when possible, by the first day of June, providing they give written assurance of their intentions to return to that assignment (including extra- curricular assignments, where applicable) on or before the same date. In the event changes are made in an individual teacher's schedule after June 1, notification will be promptly sent to the teacher so affected. At that time, if the teacher is not satisfied with the assignment, the teacher may choose to be released from his/her contract without repercussions.
E. Any assignments in addition to the normal teaching schedule during the regular school year, including extra duties enumerated in Appendix A, shall not be obligatory but shall be with the consent of the teacher. Assignments of extra duties will be made annually at the discretion of the Board.
F. To the extent that a more experienced teacher acts as a mentor or coach to a newly hired or less experienced teacher, it is understood that such mentoring will be voluntary on the part of the more experienced teacher, and further, that the professional relationship between the mentor and mentee shall be confidential as regards evaluation or disciplinary processes, which processes shall remain the responsibility of the Board.

All teachers employed by the Genesee School District must posses a Valid Michigan Provisional, Permanent, Continuing or Professional Certificate or the appropriate license. The employment of new teachers whose certification is anything less than a Valid Michigan Provisional, Permanent, Continuing or Professional Certificate or the appropriate license is to be permitted only in a case of absolute necessity and by mutual consent of the Association and the Board. In each instance the Board shall indicate the extent to which it has endeavored to fill the position with a fully certified person. No person whose certification is based on less than a Valid Michigan Provisional, Permanent, Continuing or Professional Certificate or the appropriate license shall be employed in a regular full time position for more than one year. The individual contract shall provide for immediate termination in the event a person with a Valid Provisional, Permanent, Continuing or Professional Certificate or appropriate license is hired for that position.
B. Teachers shall not be assigned outside the scope of their teaching certificates except temporarily and for good cause, and the Association shall be so notified in writing in each instance, along with written statement of reasons for such misassignment. Temporary shall be defined for purposes of this Article as not to extend beyond the current school year.
C. All teachers shall be given written notice of their schedules for the forthcoming year no later than the preceding first day of June. In the event that changes in such schedule are proposed, all teachers affected shall be notified promptly and consulted. In no event will changes in teachers’ schedules be made later than the 15th day of August preceding the commencement of the school year, unless an emergency situation requires same, and the Association shall be notified in writing in each instance.
D. Any assignments in addition to the normal teaching schedule during the regular school year, including Adult Education courses, driver education, and extra duties enumerated in Appendix B, and summer school courses, shall not be obligatory but shall be with the consent of the teacher. Preference in making such assignments will be given to fully certified teachers regularly employed in the district.

PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. A. A certified employee shall be given notice of his/her tentative assignment for the forthcoming year no later than five (5) days before the last day of school of the current year. In case of involuntary transfers, notification to the certified employee shall be given after the student-school day with rationale given for the decision. The certified employee shall be given three (3) days to respond in writing or in conference before the final decision is made. The certified employee may request Association representation. Should the certified employee choose not to accept the assignment, he/she may resign.
B. Unit Positions
1. A vacancy shall exist when a new bargaining-unit position is created or when an existing bargaining-unit position is vacated as a result of termination, resignation, retirement, transfer, or death.
2. At any time, a certified employee may request in writing a change in teaching assignment to a different grade level, building, or academic area. The notification shall indicate all areas of interest. This transfer request will be confidential. Should a related vacancy occur, it is the responsibility of the certified employee to contact the District Administrative Service Center to express interest in the vacancy. The written notification of interest shall remain on file in the District Administrative Services Center (ASC) through the first teacher-attendance day of each school year.
3. Vacancies in bargaining unit positions shall require an internal posting of three (3) school-business days. After three (3) days of internal posting, positions will be posted publicly. Postings shall be made at all buildings before the end of the business day. The President of the Bethalto Education Association shall be notified by e-mail before the end of the business day. All postings will be emailed to the Eagles Nest email group, added to a folder labeled "District Employment Opportunities" within the district's shared Google drive, and posted on the District website. If the original posting occurs after 2:00 P.M. on the first day of posting, the next business day will be considered the first day of the required three (3) days of posting.

PROFESSIONAL QUALIFICATIONS AND ASSIGNMENTS. A. In the event that changes in teaching assignments are necessary for the following regular school year, affected Members shall be notified prior to May 1st of the current regular school year.
B. Teaching assignments in addition to the normal teaching schedule during the regular school year include:
