Project Acceptance. The Owner shall acknowledge final inspection and completion of the Project by executing a Certificate of Acceptance and recording a Notice of Completion in accordance with the General Conditions. The validity of this Sublease will not be affected by any delay in or failure of completion of the Project.
Project Acceptance. 7.1 The following standards and methods are agreed by the two parties to be used to inspect the functional completion of the construction:
7.1.1 The items indicating as the functional completed of the constructions by Party B:
(1) CDQ waste heat power generation: the power station can produce electricity normally;
(2) Smoke pipeline waste heat recovery: supply steam gas pursing to the design requirements;
7.1.2 Functional completion and acceptance standards: refer to design requirement;
7.1.3 Acceptance for functional completion: Party B organizes and examines the constructional engineering and installation engineering involved into the project as well as assumes related expenses. The professional and government inspections and acceptance will be coordinated by Party A which will assume related expenses, including environmental protection, fire fighting, industrial hygiene, records, pressure vessel (boiler detection), electrical equipment, anti-thunder and hoisting equipment.
7.1.4 Acceptance time, date and personnel: within 15 days after Party B informs Party A that the power station is qualified for acceptance, both parties negotiate the place and personnel.
7.2 Party A cooperates with Party B to organize the construction contractor for project inspection and acceptance. If the equipment works 72 hours continually and the project is under stable operation, the project passes acceptance inspection. The project acceptance report should be signed by the supervisors and technicians of the both parties that participate the acceptance inspection as well as seals on the report by all entities participated in the acceptance inspection. The acceptance report should indicate the operational instrument data, operation state and instant effects. The acceptance inspection to CDQ waste heat power generation system and smoke pipeline waste heat utilization system can be conducted separately upon its completion.
7.3 The execution date of the acceptance report will be regarded as the date when the project is under stable operation state. Since then, the produced electricity and steam will be considered officially supplying to Party A.
Project Acceptance. District shall acknowledge final inspection and completion of the Project by executing and recording a Notice of Completion. The validity of this Sublease will not be affected by any delay in or failure of completion of the Project.
Project Acceptance. Contractor shall provide written notice to ATL when Contractor believes it has achieved Substantial Completion of the Work, including Punch List items, and request a final inspection by ATL. Within three (3) Business Days of ATL’s receipt of Contractor’s written notice, ATL will advise Contractor in a written notice of decision that it will perform the inspection or why ATL does not believe the Project is ready for a final inspection. If the Project is not ready for final inspection, Contractor will perform the Work needed before Contractor makes another written request for final inspection to ATL. If the Project is ready for final inspection, ATL will perform the final inspection within three (3) Business Days of ATL’s notice of decision. ATL shall notify the Contractor in writing of Project Acceptance as of the date of the final inspection. If, however, the review discloses any Work, in whole or in part, as being unsatisfactory, ATL will give the Contractor the necessary instructions for correction of same and the Contractor shall immediately comply with and execute such instructions. Upon correction of the Work, another inspection will be made which shall constitute the final inspection, provided the Work has been satisfactorily completed. In such event, ATL will notify the Contractor in writing of Project Acceptance as of the date of successful final inspection.
Project Acceptance. The Owner shall perform a final inspection and acknowledge completion of the Work, as set forth in Article 9.7
Project Acceptance. The following acceptance criteria are used to acknowledge acceptance of the final project deliverable: • All Northwoods-assigned project work requirements have been completed. • All project deliverables have been accepted. The Northwoods Project Manager submits a Project Acceptance form once project acceptance criteria have been achieved. The ▇▇▇▇▇▇ HSSD Project Sponsor, or authorized designee, evaluates whether the final project deliverable meets project acceptance criteria listed above. If the final project deliverable meets the project acceptance criteria, the ▇▇▇▇▇▇ HSSD Project Sponsor, or authorized designee, signs the Project Acceptance form within five business days to acknowledge acceptance of the project. Should the final project deliverable fail to conform to acceptance criteria, the ▇▇▇▇▇▇ HSSD Project Sponsor, or authorized designee, documents any deficiencies in the Project Acceptance form and returns the form to the Northwoods Project Manager within five business days. The Northwoods Project Manager then facilitates corrective action and resubmits the Project Acceptance form once corrective action is complete. If the Project Acceptance form is not returned to the Northwoods Project Manager within five business days, the project is considered accepted by the customer.
Project Acceptance. Upon notice from DataSync, Client agrees to evaluate any changes or modifications made by DataSync and to accept or reject such modifications as soon as practical but in no event later than ten (10) business days after its receipt of DataSync’s notice. If Client identifies any problems prior to acceptance, it shall explain in written detail the reason for its rejection within the acceptance period and if DataSync is then able to validate the problems, then it shall use its commercially reasonable best efforts to correct the problems within a reasonable time period. If the work submitted by DataSync for acceptance forms the basis for ongoing work, DataSync may suspend its performance of such other ongoing work pending acceptance by Client, and such suspension shall automatically extend the deadline for such work. The procedures outlined in this Section 2.3.2.4 shall be repeated until the work is accepted. Notwithstanding the foregoing, Client hereby acknowledges and agrees that all problems with any Third Party Software that was not changed or modified by DataSync, are the sole responsibility of the Third Party Software vendor. Project Acceptance. The project budget set forth in this agreement specifies allowable funding for administrative costs, program delivery costs, and/or project costs. The Subrecipient shall not engage in, or in any way commit funding for, through a contract or other mechanism, construction or any other activities that could have an environmental impact or limit the choice of reasonable alternatives to the proposed project (“Restricted Activities”). . Prior to undergoing Environmental Review and receiving Authority to Use Grant Funds (each as defined below), the schedule for a proposed project set forth in Schedule A shall provide, with reasonable specificity, a proposed schedule for the proposed project as well as a description and schedule for activities proposed to be conducted in each phase of the proposed project.
Project Acceptance. 7.1 Prior to acceptance of the Project and WSDOT’s construction administration, WSDOT and the LOCAL AGENCY will perform a joint final inspection of the Project. The LOCAL AGENCY agrees, upon satisfactory completion of the Project by its Contractor and receipt of a “Notice of Physical Completion,” as determined by WSDOT, to deliver a letter of acceptance of the Project and WSDOT’s construction administration which shall include a release of WSDOT from all future claims or demands, except from those resulting from the negligent performance of WSDOT’s construction administration under this Agreement.
7.2 If a letter of acceptance of the Project is not received by WSDOT within sixty (60) calendar days following delivery of a “Notice of Physical Completion” of the Project to the LOCAL AGENCY, the Project and WSDOT’s construction administration shall be considered accepted by the LOCAL AGENCY and WSDOT shall be released from all future claims or demands, except from those resulting from the negligent performance of WSDOT’s construction administration under this Agreement.
7.3 The LOCAL AGENCY may withhold its acceptance of the Project and WSDOT’s construction administration by submitting written notification to WSDOT within sixty (60) calendar days following “Notice of Physical Completion” of the Project. This notification shall include the reason(s) for withholding the acceptance. The Parties shall then work together to resolve the outstanding issues identified in the LOCAL AGENCY’s written notification. Upon resolution of the outstanding issues, the LOCAL AGENCY will promptly deliver the letter of acceptance to WSDOT.
Project Acceptance. Acceptance of the project by City will not be considered until all construction and testing is completed and as-built plans submitted. Upon City's approval of the same, acceptance will be documented by issuance of an acceptance letter by City.
