The Project Representation clause defines the parties responsible for acting on behalf of each side in relation to the project. PROJECT REPRESENTATION. The City agrees to appoint a Project Representative to assist in obtaining information from various City departments as requested by Professional and in coordinating, monitoring, and evaluating the project to its completion. The Project Representative has no control over the means, methods, techniques, or procedures employed by Professional. The City is interested only in the results obtained under this contract; the manner and means of obtaining those results is solely under the Professional's control.
PROJECT REPRESENTATION a. If more extensive representation at the site is required by the School District than is provided for in the Agreement, the Professional shall provide one or more Full Time Project Representative(s). Such Full Time Project Representative(s) shall be selected, employed and directed by the Professional, and such selection shall be approved by the School District. b. The Full Time Project Representative(s) shall, through continuous on-site observations, exercise good faith and due care to provide further protection to the School District against defects or deficiencies in the performance of the construction contracts, but the furnishing thereof shall not relieve the Professional of the responsibilities under the Agreement.
PROJECT REPRESENTATION. Contractor has reviewed the provisions of the Supply Contract and undertakes to Owner that the combination of the Work and the Equipment are adequate so that the Project, when completed in accordance with this EPC Contract, will meet the requirements of Owner set forth in Exhibit A.

Direction from any other source, without prior approval of the Public Works Director, shall be considered void. 5.2 The CONTRACTOR designates as its Project Manager. The TOWN may rely upon the guidance, opinions, and recommendations provided by the CONTRACTOR and its representatives. Should any of the representatives be replaced, particularly ▇▇▇▇ ▇▇▇▇▇, and such replacement require the Town or the Contractor to undertake additional re-evaluations, coordination, orientations, etc., the CONTRACTOR shall be fully responsible for all such additional costs and services.
PROJECT REPRESENTATION. If more extensive representation at the site by the Professional is required by the Owner than is provided for under Basic Services, Paragraph 2.6, Construction Phase, the Professional shall provide one or more Project representatives to assist in carrying out such additional on-site representation. Additional Project representative(s) shall be selected, employed, and directed by the Professional with the approval of the Owner, and the Professional shall be compensated therefore as mutually agreed, in advance, between the Owner and the Professional. Such supplemental agreement letter shall also delineate the duties and responsibilities of the additional Project representative(s).
PROJECT REPRESENTATION. Consulting Engineer and City shall each designate in writing within ten (10) days from the date of execution of this agreement a representative who shall be responsible for coordinating the efforts of their respective party with regard to the performance of the work as set forth under this Agreement Representation may be changed upon the mutual agreement of the City and Consulting Engineer. It is understood and agreed that as Consulting Engineer, MKN & Associates, Inc., shall not undertake work for private clients, except for services that have no relationship to any area of the City’s jurisdiction or discretionary authority, within the corporate limits or immediate area of influence of the City of Coalinga throughout the duration of this Agreement. Should any of MKN & Associates, Inc. clients for projects in other geographic areas undertake work within the City’s jurisdiction or discretionary authority, MKN & Associates, Inc. shall advise the City. In such cases, at the City’s sole election, City may obtain replacement engineering services to review, inspect and approve such developments in order to avoid an actual or the appearance of conflict. If desired by City, MKN & Associates, Inc. will assist City in such replacement effort.
