Project Responsibilities. With regard to project responsibilities under this Agreement, the parties agree to contribute as follows: (A) The Entity will be responsible for the preparation of detailed right- of-way and construction plans and project specifications. This includes design, letting of project, and inspection of project. The plans shall be prepared in accordance with and conform to Commission requirements. The Commission will review the plans and specifications for all construction work that will take place on the Commission’s right of way. The Entity will make any corrections or modifications requested by the Commission prior to the issuance of the permit authorizing work on the Commission’s right of way. (B) Additional right of way is not anticipated on this project. (C) The Entity will be responsible for letting the work for the herein improvement, which includes advertising the project for bids and awarding the construction contract. The Entity will solicit bids for the herein improvement in accordance with plans developed by the Entity, or as the plans may from time to time be modified in order to carry out the work as contemplated. The Entity will award the contract to the lowest, responsive, responsible bidder. Prior to awarding the contract, the Entity will obtain concurrence in award from the Commission. The Entity will submit all required bid concurrence documentation to the Commission at least 2 weeks prior to the Commission Meeting in which the Entity seeks to request award. (D) The Entity will obtain a no cost permit from the Commission’s district engineer prior to working on the Commission’s right of way, which shall be signed by an authorized contractor representative (a permit from the Commission’s district engineer will not be required for work outside of the Commission’s right of way). (E) The Entity will be responsible for construction of the herein improvements, which includes administration of the construction contract and inspection of the project work. The project shall be constructed in accordance with and conform to Commission requirements. The details of the cost breakdown may be seen in “Exhibit B,” which is incorporated herein and attached hereto.

(A) The Entity will shall be responsible for all aspects of the project including design engineering, acquisition of right of way, relocation of utilities, letting the project, construction, and inspection of the project.
(B) The Entity shall follow the commission’s Local Public Agency (LPA) policy and procedures for all aspects of the project.
(C) The Entity shall provide preliminary and final design engineering for the preparation of detailed right- right-of-way and construction plans and project specifications. This includes design, letting coordination with all public and private utility owners within the project limits and relocation of project, and inspection of utilities impacted by the project. The plans shall be prepared in accordance with and conform to Commission requirements. The Commission will review the plans and specifications for all construction work that will take place on the Commission’s right of wayrequirements, standards, and specifications. The Entity will make any corrections Said plans shall not be changed in concept or modifications requested by the Commission scope without prior to the issuance written approval of the permit authorizing work on the Commission’s right of way.
(BD) Additional The Entity shall acquire any additional right of way is not anticipated on this projectrequired for the project and in doing so agrees that it will comply with applicable federal laws, rules and regulations, including 42 U.S.C. 4601-4655, the Uniform Relocation Assistance and Real Property Acquisition Act, as amended and any regulations promulgated in connection with the Act.
(CE) The Entity will shall be responsible for letting the work for the herein improvementProject, which includes advertising the project for bids and awarding the construction contract. The Entity will shall solicit bids for the herein improvement Project in accordance with plans developed by the Entity, or as the plans may from time to time be modified in order to carry out the work Project as contemplated. The Entity will shall not award the construction contract without obtaining Commission’s concurrence in the award. If the Entity awards the construction contract without concurrence, the Commission is under no obligation to continue participation in the lowestcost of the project.
(F) The Entity shall secure all required federal, responsivestate, responsible bidderand local permits as required for design and construction of the Project. Prior to awarding entering onto the contractCommission right of way to perform any obligation under this Agreement, the Entity will shall obtain concurrence in award from the Commission. The Entity will submit all required bid concurrence documentation to the Commission at least 2 weeks prior to the Commission Meeting in which the Entity seeks to request award.
(D) The Entity will obtain a no cost any applicable permit from the Commission’s district engineer prior to working on , unless the Commission’s right performance of way, which shall be signed by an authorized contractor representative (such obligations under this Agreement would not ordinarily require a permit from the Commission’s district engineer will not be required for work outside of the Commission’s right of way).
(EG) The Entity will shall be responsible for construction of the herein improvementsProject, which includes administration of the construction contract and inspection of the project Project work. The project Project shall be constructed in accordance with and conform to the current criteria and requirements established and adopted by the Commission requirements. The details and in accordance with current applicable manuals and policies of the cost breakdown may Commission and the Federal Highway Administration (FHWA), if applicable, which will be seen in furnished by the Commission upon request, and, absent the foregoing, with manuals and policies of the American Association of State Highway and Transportation Officials (“Exhibit B,” which is incorporated herein AASHTO”).
(H) The Commission will provide preliminary engineering review, right of way acquisition review, and attached heretoconstruction engineering review of the project to ensure compliance with the Commission’s policies and procedures.
