Project Schedules. Project Schedules for individual Release Orders will be established by the Contractor in conjunction with the Princeton University Project Manager and, to the maximum extent possible, shall be based on performance of Work during normal work hours at Straight Time Rates (see Article VII(b)). Any Work that must be performed outside of normal work hours and/or requiring the payment of Overtime or Double Time Rates shall be justified by the Contractor in its Project/job estimate and approved in advance by the Princeton University Project Manager. Princeton University will not pay Overtime or Double Time Rates unless specifically agreed to and addressed in an individual Release Order.

Project Schedules. 8.1. Proposed Commercial Operational Date for the System will be prior to September 30, 2015, provided, however, and for avoidance of doubt, the Parties acknowledge and agree that such date is only an estimate and not guaranteed.

Project Schedules. Contractor shall submit a proposed Project schedule (Schedule) as follows: a. Schedule identifying all tasks within the critical path. The proposed Project schedule shall be submitted within ten (10) calendar days of the Notice of Award and such submittal shall be subject to the Project Manager’s review. Subsequent to such review of said Schedule the Contractor shall establish said schedule as the baseline Schedule. b. The Schedule shall be prepared in the form of a horizontal bar chart with separate horizontal bars for each design task, construction task in the critical path in chronological order. Provide horizontal time scale in weeks from the start of construction and identify the first work day of each month. Identify listings of any major equipment installation milestones. c. All updates of the Schedule shall be tracked against the baseline schedule and shall be at a minimum submitted with each pay application and prior to a Notice to Proceed being issued for each Phase of the Project. The Schedule shall be updated to reflect changes or requirements required by DERM. An updated Schedule against the baseline shall also be submitted upon execution of each change order that impacts the Contract Time for completion. Failure to submit such Schedules shall result in the rejection of any submitted payment application. d. All Schedules shall be prepared in Microsoft Project 2003 or earlier unless otherwise approved by the Project Manager. At the time of submission of Schedules Contractor shall submit a hard copy as well as an electronic version. Such electronic version shall not be submitted in a .pdf format and shall be capable of being incorporated in to the City’s master Project schedule. e. Subsequent to review of the initial Schedule submission the Contractor shall establish the reviewed Schedule as the “Baseline Schedule”. Contractor shall then prepare and submit all updates to the Schedules utilizing the tracking mode within Microsoft Project. At a minimum the contents of the Baseline Schedule shall show or indicate the following: a. Complete sequence of site investigation, SAR report preparation, regulatory coordination, remedial action planning, RAP regulatory coordination, and design of the remedial action by activity reflecting the Subconsultant responsible for the activity. b. Project Schedules. Design-Build Firm shall submit a proposed design-build Project schedule, with any sub-schedules of related activities that are essential to its progress, within ten (10) working days of the Notice of Award and such submittal shall be subject to the Project Manager and Consultant’s review, comment, and acceptance. Subsequent to such review of said schedule the Design-Build Firm shall establish said schedule as the baseline schedule. All Project Schedules shall be prepared in Microsoft Project 2003 or earlier unless otherwise approved by the Project Manager. At the time of submission of schedules Design-Build Firm shall submit a hard copy as well as an electronic version. Project Schedules. Construction Manager will receive, review and comment on the suitability of the detailed construction schedule prepared by the Contractor. Once approved, Construction Manager will monitor the schedule monthly and report on deviations from the schedule. Construction Manager will recommend necessary actions to Owner should the Contractor fail to correct schedule variances caused by the Contractor.

Project Schedules. Tenant shall provide project scheduling based upon the Design and Construction Schedule Requirements and Milestones. The Design and Construction Schedule and Milestones will serve as an essential measurement of Tenant's compliance with the terms of the Lease. Tenant shall, based upon electronic templates provided by Landlord, provide a project schedule which incorporates a schedule of design submittals, a materials procurement schedule and a construction activities schedule. The project schedule shall fully integrate the work of all designers, contractors, subcontractors and major suppliers. Tenant shall submit the initial project schedule to Landlord within 21 calendar days of Lease signing. The schedule shall employ the Critical Path Method in development and maintenance of the schedule in Precedence Diagram Mode. The CPM network shall incorporate activity descriptions, sequence, logic relationships, duration estimates and resource loading. Tenant shall not use any "float suppression" techniques in preparing the schedule, such as preferential sequencing or logic, special lead/lag constraints or over-estimating activity durations. Time units for all schedules shall be in work days, and no construction activity scheduled to commence within 60 days of the data date shall have a duration greater than 5 work days. Construction activities scheduled to start more than 60 days from the data date shall not have a duration exceeding 20 days. Tenant shall provide all data files to Landlord electronically. Upon first acceptance by Landlord, the project schedule shall become the "Baseline Schedule" against which all subsequent schedule updates shall be made, and against which Tenant shall report progress and variances and by which Landlord will monitor Tenant's compliance with Lease requirements and Design and Construction Schedule Requirements and Milestones. Landlord and Tenant will conduct bi-weekly reviews of the progress of Tenant's Work and compare that progress to the agreed project schedule. This review will include actual activity start and completion dates and related variances, forecast activity start and completion dates and related variances and progress of all activities under way at the time of the review. Project Schedules. This Agreement, together with any applicable Project Schedule(s), shall constitute the entire agreement between the Parties with respect to the Project(s) identified in such Project Schedule(s). Each Party shall use Commercially Reasonable Efforts to perform the Activities assigned to such Party in each Project Schedule and to provide the Materials and Deliverables set forth therein, in each case according to the estimated timelines specified therein and subject to the assumptions set forth therein. The Parties shall carry out Activities in accordance with this Agreement and Applicable Law, including applicable GCP, GLP and GMP. Company shall use Commercially Reasonable Efforts to ensure that, when performing activities in relation to any Project, it shall meet or exceed the applicable Service Levels in accordance with Section 2.8.
