Common use of Provisional Work and Rates Clause in Contracts

Provisional Work and Rates. If there is a dispute between the Parties as to the Work to be performed or the Rates to be paid for such Work: (a) until such dispute is resolved in accordance with this Agreement, the Parties will continue to observe their respective rights and obligations under this Agreement; (b) the Work to be performed and the Rates to be paid that are the subject of the dispute will be performed and paid in accordance with any Logging Plan or rate proposal, as the case may be, provided by the Company; and (c) the Rate determined through dispute resolution under this Agreement is retroactive to the commencement of the Work in respect of that Rate.
